Exemption — refuelling in Ordinance Loading Areas at Tindal
1          Duration
                 This instrument:
(a)   commences on 1 December 2011; and
(b)   stops having effect at the end of 30 November 2014.
2          Application
                 This instrument applies to Pel-Air Aviation Pty Limited, Aviation Reference Number 227573 (the operator), when fuelling operations are being conducted within Ordinance Loading Areas (OLAs) at the Royal Australian Air Force base at Tindal.
3          Exemption
                 An aircraft operated by the operator is exempt from compliance with subregulations 235 (7), (7A) and (8) of the Civil Aviation Regulations 1988 (CAR 1988) to the extent mentioned in Schedule 1.
4          Conditions
                 The exemption is subject to the conditions mentioned in Schedule 2.
Schedule 1          Extent of exemption
              The exemption extends only to the direction under subregulation 235 (7) of CAR 1988 that is contained in subparagraph 4.1.1 (d) of Civil Aviation Order 20.9.
Schedule 2          Conditions
        1     This exemption applies only to the fuelling of Westwind aircraft engaged in Australian Defence Force (ADF) support operations.
        2     The fuelling operations must be carried out by trained ADF personnel in accordance with the established procedures for refuelling in OLAs.
        3     The equipment installed in OLAs, to ensure the safety of fuelling operations, must be serviceable.
