Revocation of approval under section 22-10 of the Higher Education Support Act 2003 (HESA)
 
(1)    I, Neil McAuslan, a delegate of the Minister for Tertiary Education, Skills, Jobs and Workplace Relations for the purposes of section 22-20 of HESA:
 
(a)           did provide a notice on 11 July 2011, to East Coast Gestalt Training Incorporated advising that the Minister was intending to revoke the body’s approval as a higher education provider;
(b)          the intention to revoke approval as a higher education provider was pursuant to subsection 22-10(3) of HESA as East Coast Gestalt Training Incorporated:
                                            I.            was a non self-accrediting entity at the last time the body became a higher education provider;  and
                                          II.            since that time, the body has ceased to be a non self-accrediting entity as the body’s name has ceased to be included in the Australian Qualification Framework Register;
(c)           did consider the written submission provided by East Coast Gestalt Training Incorporated on 12 August 2011, regarding why the body’s approval as a higher education provider should not be revoked; and
(d)         shall cause a copy of this notice to be given to East Coast Gestalt Training Incorporated as required by subsection 22-20(3) of HESA.
 
(2)    I, Neil McAuslan, a delegate of the Minister for Tertiary Education, Skills, Jobs and Workplace Relations hereby revoke the approval of East Coast Gestalt Training Incorporated as a higher education provider pursuant to subsection 22-10(3) of HESA.
 
(3)    I, Neil McAuslan, a delegate of the Minister for Tertiary Education, Skills, Jobs and Workplace Relations for the purposes of section 22-25(1)(b) of HESA, hereby determine that revocation of East Coast Gestalt Training Incorporated approval as a higher education provider is of no effect for the purposes of assistance payable to the body’s students who have not completed the courses of study in which they were enrolled with East Coast Gestalt Training Incorporated on 21 November 2011.
 
In accordance with subsection 22-20(5)(a) of HESA the revocation shall take effect on
22 November 2011.
