Amendments to Guidelines made under section 238-10 of the Higher Education Support Act 2003
 
 
 
I, Chris Evans, Minister for Tertiary Education, Skills, Jobs and Workplace Relations pursuant to section 238-10 of the Higher Education Support Act 2003 (‘the Act’), make the attached amendment to the Commonwealth Grant Scheme Guidelines No.1, which provide for matters under Part 2-2 and section 93‑10 of the Act.

1                CITATION
 
This legislative instrument may be cited as Amendment No. 8 to the Commonwealth Grant Scheme Guidelines No.1
 
2                AUTHORITY
 
This legislative instrument is made under section 238-10 of the Higher Education Support Act 2003 (the Act) to give effect to matters set out in Part 2-2 of the Act.
 
3                DATE OF EFFECT
 
This legislative instrument will come into effect the day after registration on the Federal Register of Legislative Instruments.
 
4                    AMENDMENTS
 
This legislative instrument amends the Commonwealth Grant Scheme Guidelines No.1 which were registered on 12 December 2006 and which commenced on 13 December 2006 (see F2006L04079). A compilation (see F2010C00040) was prepared on 18 December 2009 taking into account amendments up to Amendment No. 6 (see F2009L04058). A seventh amendment was registered on 22 December 2010 and commenced on 23 December 2010 (see F2010L03377).
 
PURPOSE
 
The purpose of this legislative instrument is to insert a new Chapter 12 into the Commonwealth Grant Scheme Guidelines No.1.

CHAPTER 12  PERFORMANCE FUNDING GRANT AMOUNT – FACILITATION FUNDING
12.1        PURPOSE
 
12.1.1     This chapter outlines the calculations for determining how the Facilitation Funding component of the Performance Funding grant amount will be worked out for 2011 and later years under subsection 33‑1(1A) of the Act.
 
12.5       FACILITATION FUNDING ELIGIBILITY
 
12.5.1    A higher education provider will eligible for Facilitation Funding if:
 
a)    the provider is a Table A provider; and
b)    the Minister has allocated a number of Commonwealth Supported Places to the provider for that year under section 30-10 of the Act; and
c)    the provider has entered into a funding agreement with the Commonwealth under section 30-25 of the Act in respect of that year (the 2011-2013 Compact period).
 
12.5.5    In order to receive Facilitation Funding from 2011, providers must:
a)    inform the Commonwealth of strategies and goals for achieving the provider’s teaching and learning mission described under clause 4.7 of the provider’s 2011-13 Compact; and
b)    agree to the performance targets relating to specific Commonwealth goals contained in clause 4.14 of the provider’s 2011-13 Compact.
 
12.10     CALCULATION OF FACILITATION FUNDING
 
12.10.1  The Facilitation Funding available in a given year is comprised of:
 
a)    a ‘Basic Grant Amount component’ – the Facilitation Funding to be distributed based on provider shares of the Basic Grant Amount of the same year (section 33‑5 of the Act). In 2011 this component is $91,010,141. This amount will be indexed in later years in accordance with the method set out in Part 5-6 of the Act; and
 
b)    a ‘Grants to Support National Institutes specified in the Other Grants Guidelines component’ – the Facilitation Funding to be distributed based on provider shares of the Grants to Support National Institutes specified in the Other Grants Guidelines amount of the same year (item 4 of subsection 41-10 of the Act). In 2011 this component is $3,229,213. This amount will be indexed in later years in accordance with the method set out in Part 5-6 of the Act.
 
The ‘Basic Grant Amounts’ referred to herein is the estimated Basic Grant Amount to be distributed in a given year as at 1 January of that year.
 
The ‘Grants to Support National Institutes specified in Other Grants Guidelines amount’ referred to herein is the estimated Grants to Support National Institutes specified in Other Grants Guidelines amount to be distributed in a given year as at 1 January of that year.
 
12.10.5 The formula for calculating each provider’s Facilitation Funding payment in a given year is:
 
 
a)    The Basic Grant Amount component
