BASS STRAIT CENTRAL ZONE SCALLOP FISHERY (Closures) DIRECTION No. 2 2011
I, James Findlay, Chief Executive Officer of the Australian Fisheries Management Authority, as delegate under delegation No. 1 of 2011 made on 28th January 2011 from the Commission, make the following Direction under section 41A(2) of the Fisheries Management Act 1991.

Citation
1. This Direction may be cited as Bass Strait Central Zone Scallop Fishery (Closures) Direction No.2 2011.
Commencement
2. This Direction commences on 27 July 2011.
Period of Application
3. This Direction applies for the period beginning on the date this Direction commences and ends at the end of 31 December 2012 unless earlier revoked.
To Whom This Direction Applies
4. This Direction applies to a holder of a fishing concession in the Bass Strait Central Zone Scallop Fishery and to a person acting on behalf of the holder.
[Note: This means that the Direction does not apply to a person if the person is fishing in the area of the Fishery in accordance with a fishing concession that is subject to another plan of management in force under the Act, under a scientific permit, a permit issued in another fishery, or under a licence issued under a law of a State or Territory.]
Interpretation
5. A term used in this Direction that is defined in the Bass Strait Central Zone Scallop Fishery Management Plan 2002 (the Management Plan) has the same meaning in this Direction as it has in the Management Plan.
Direction Not to Engage in Fishing
6. Fishing is not to be engaged in the Bass Strait Central Zone Scallop Fishery.
Exemption to the Prohibition in Clause 6
7. Until 31 December 2011, the prohibition in clause 6 does not apply to the following area of water in the Bass Strait Central Zone Scallop Fishery:
Fishing Area X – the area of waters contained within and bounded by a line:
i. Commencing at the point of intersection of the parallel of latitude 39o15.00’South and the meridian of longitude 148o22.50’East;
ii. and proceeding east along the parallel of latitude 39o15.00’South to the intersection with the meridian of longitude 148o32.50’East;
iii. then south along the meridian of longitude 148o32.50’East to the intersection with the parallel of latitude 39o20.00’South;
iv. then west along the parallel of latitude 39o20.00’South to the intersection with the meridian of longitude 148o27.50’East;
v. then south along the meridian of longitude 148o27.50’East to the intersection with the parallel of latitude 39o22.00’South;
vi. then west along the parallel of latitude 39o22.00’South to the intersection with the meridian of longitude 148o25.00’East;
vii. then north along the meridian of longitude 148o25.00’East to the intersection with the parallel of latitude 39o20.00’South;
viii. then west along the parallel of latitude 39o20.00’South to the intersection with the meridian of longitude 148o22.50’East;
ix. then north along the meridian of longitude 148o22.50’East to the point of commencement.
Condition
8. It is a condition of all concessions to which this Direction applies that the holder, or a person acting on behalf of the holder, complies with this Direction.
Revocation of Direction No. 1 of 2011
9. This Direction revokes Bass Strait Central Zone Scallop Fishery (Closures) Direction No.1 2011 from 27 of July 2011.
