I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Administrative Appeals Tribunal Act 1975.

1              Name of Regulations
                These Regulations are the Administrative Appeals Tribunal Amendment Regulations 2011 (No. 1).
2              Commencement
                These Regulations commence, or are taken to have commenced, as follows:
                (a)    on 1 November 2010 — regulations 1 to 3 and Schedule 1;
               (b)    on the day after they are registered — regulation 4 and Schedule 2.
3              Amendment of Administrative Appeals Tribunal Regulations 1976
                Schedule 1 amends the Administrative Appeals Tribunal Regulations 1976.
4              Amendment of Administrative Appeals Tribunal Regulations 1976
                Schedule 2 amends the Administrative Appeals Tribunal Regulations 1976.
Schedule 1        Amendments taken to have commenced on 1 November 2010

[1]           Paragraph 19 (8) (b)
before
the Tribunal

the person paid an application fee and
[2]           Subregulation 19 (9)
substitute
         (9)   The refund amount is:
                (a)    if the application was lodged before 1 November 2010 — the application fee; and
               (b)    if the application is lodged on or after 1 November 2010 — the difference between the application fee and $100.
[3]           Paragraph 19AA (8) (e)
substitute
                (e)    the person paid the standard application fee and the Tribunal certifies that proceedings have terminated in a manner favourable to the applicant; or
                (f)    the person paid the lower application fee and the additional fee and the Tribunal certifies that proceedings have terminated in a manner favourable to the applicant.

                (e)    for paragraph (8) (e):
                          (i)    if the application was lodged before 1 November 2010 — the application fee; or
                         (ii)    if the application was lodged on or after 1 November 2010 — the difference between the application fee and $100; and
                (f)    for paragraph (8) (f):
                          (i)    if the application was lodged before 1 November 2010 — the sum of the lower application fee and the additional fee; or
                         (ii)    if the application was lodged on or after 1 November 2010 — the difference between the sum of the lower application fee and the additional fee, and $100.
