I, TIM YOUNGBERRY, First Assistant Secretary, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under subsection 32(2) of the Financial Management and Accountability Act 1997 (the FMA Act).
This Determination is made due a decision of the Australian Government to transfer the Arts and Culture function from the Department of Sustainability, Environment, Water, Population and Communities to the Department of the Prime Minister and Cabinet.

1              Name of Determination
This Determination is the Financial Management and Accountability Act 1997 Determination 2011/02 – Section 32 (Transfer of Functions from DSEWPC to DPMC).
Note 1: This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation in accordance with section 62 of the FMA Act. The Secretary has delegated his power in accordance with section 53 of the FMA Act.
Note 2: Acronyms used in this Determination are as follows:
(a)      “DSEWPC” – refers to the Department of Sustainability, Environment, Water, Population and Communities; and
(b)      “DPMC” – refers to the Department of the Prime Minister and Cabinet.
Note 3: Functions relating to Arts and Culture were transferred from the Department of Sustainability, Environment, Water, Population and Communities to the Department of the Prime Minister and Cabinet due to a change to the Administrative Arrangements Order with effect from 14 September 2010.
2              Commencement
This Determination commences on the day on which it is made.
Note: Under subsection 32(8) of the FMA Act, a determination may be expressed to take effect before its making and registration under the Legislative Instruments Act 2003.
3              Amendment of Appropriation Act (No. 1) 2010-2011
Schedule 1 amends Appropriation Act (No. 1) 2010-2011 to transfer:
(a)    $18,800,149.31 of the departmental item for DSEWPC to the departmental item for DPMC;
(b)   $29,573,693.46 of DSEWPC’s administered item for outcome 5 to DPMC’s administered item for outcome 2.
(c)    $40,801,500 of the CAC Act body payment item for the Australia Council from DSEWPC to DPMC.
(d)   $9,897,219 of the CAC Act body payment item for the Australian Film, Television and Radio School from DSEWPC to DPMC.
(e)    $8,572,000 of the CAC Act body payment item for the Australian National Maritime Museum from DSEWPC to DPMC.
(f)    $12,332,500 of the CAC Act body payment item for the National Gallery of Australia from DSEWPC to DPMC.
(g)   $20,420,145 of the CAC Act body payment item for the National Library of Australia from DSEWPC to DPMC.
(h)   $11,151,108 of the CAC Act body payment item for the National Museum of Australia from DSEWPC to DPMC.
(i)     $10,261,250 of the CAC Act body payment item for the National Film and Sound Archive from DSEWPC to DPMC.
(j)     $2,411,000 of the CAC Act body payment item for Screen Australia from DSEWPC to DPMC.
4              Amendment of Appropriation Act (No. 2) 2010-2011
Schedule 2 amends Appropriation Act (No. 2) 2010-2011 to transfer:
(a)    $682,500 of the CAC Act body payment item for the Australian National Maritime Museum from DSEWPC to DPMC.
(b)   $4,059,000 of the CAC Act body payment item for the National Library of Australia from DSEWPC to DPMC.
(c)    $296,666.69 of the CAC Act body payment item for the National Film and Sound Archive from DSEWPC to DPMC.
5              Amendment of Appropriation Act (No. 1) 2004-2005
Schedule 3 amends Appropriation Act (No. 1) 2004-2005 to reduce DSEWPC’s administered item for outcome 4 by $8,217,220.76.
6              Amendment of Appropriation Act (No. 1) 2005-2006
Schedule 4 amends Appropriation Act (No. 1) 2005-2006 to reduce DSEWPC’s administered item for outcome 4 by $621,966.52.
7              Amendment of Appropriation Act (No. 1) 2006-2007
Schedule 5 amends Appropriation Act (No. 1) 2006-2007 to reduce DSEWPC’s administered item for outcome 4 by $1,894,900.
8              Amendment of Appropriation Act (No. 1) 2007-2008
Schedule 6 amends Appropriation Act (No. 1) 2007-2008 to reduce DSEWPC’s administered item for outcome 4 by $3,443,358.57.
9              Amendment of Appropriation Act (No. 1) 2008-2009
Schedule 7 amends Appropriation Act (No. 1) 2008-2009 to reduce DSEWPC’s administered item for outcome 4 by $1,113,767.31.
10            Amendment of Appropriation Act (No. 1) 2009-2010
Schedule 8 amends Appropriation Act (No. 1) 2009-2010 to increase DPMC’s administered item for outcome 2 by $15,291,213.16.

Note 3: Financial Management and Accountability Act 1997 Determination 2010/29 – Section 32 (Transfer of Functions from DPMC to OAIC) amended in this table the amount alongside “Total” under the heading “Departmental”, to transfer an amount to the departmental item for the Office of the Australian Information Commissioner.
The Office of the Australian Information Commissioner was established by the Australian Information Commissioner Act 2010, effective on 1 November 2010.
Note 4: Financial Management and Accountability Act 1997 Determination 2010/31 – Section 32 (Transfer of Functions from ASIO to DPMC) amended an amount alongside “Total” under the heading “Departmental”, to transfer an amount to the departmental item from the Australian Security Intelligence Organisation.
On 14 September 2010 the ministerial portfolios were restructured and departments were renamed. Functions relating to cyber policy co-ordination were transferred from the Australian Security Intelligence Organisation to the Department of the Prime Minister and Cabinet.
Note 5: Financial Management and Accountability Act 1997 Determination 2010/35 — Section 32 (Transfer of Functions from DPMC to Finance) amended two amounts in this table:

The Australian Government has made a decision to transfer the Office of the Co‑ordinator General to the Department of Infrastructure and Transport.
Note 7: Financial Management and Accountability Act 1997 Determination 2010/40 – Section 32 (Transfer of Functions from FaHCSIA to DPMC) amended this table as follows:
