I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subclause 5F(1) of Schedule 4 to the Broadcasting Services Act 1992.

1.         Name of Determination
 
This Determination is the Broadcasting Services (Digital-Only Local Market Areas for Remote Central and Eastern Australia TV1 and Remote Central and Eastern Australia TV2) Determination (No. 1) 2012.
 
2.         Commencement
 
This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.
 
3.         Definitions
 
In this Determination:
 
ACMA means the Australian Communications and Media Authority;
 
Batchelor Transmission Site is the location at 13 degrees 02 minutes 44 seconds south latitude and 131 degrees 01 minutes 35 seconds east longitude, which is known as the Broadcast Site Mardango Crescent BATCHELOR, with the Site Identification Number 1707, as identified in the Register of Radiocommunications Licences;
 
 
digital-only local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
Jabiru Transmission Site is the location at 12 degrees 40 minutes 15 seconds south latitude and 132 degrees 49 minutes 59 seconds east longitude, which is known as the Telstra Repeater Site Gregory Place JABIRU, with the Site Identification Number 3169, as identified in the Register of Radiocommunications Licences;
 
Karumba Transmission Site is the location at 17 degrees 29 minutes 57 seconds south latitude and 140 degrees 50 minutes 14 seconds east longitude, which is known as the Broadcast Site Water Tower KARUMBA, with the Site Identification Number 153044, as identified in the Register of Radiocommunications Licences;
 
local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
Menindee Transmission Site is the location at 32 degrees 20 minutes 23 seconds south latitude and 142 degrees 24 minutes 46 seconds east longitude, which is known as the Broadcast Site 7km North of MENINDEE, with the Site Identification Number 151202, as identified in the Register of Radiocommunications Licences;
 
Normanton Transmission Site is the location at 17 degrees 40 minutes 51 seconds south latitude and 141 degrees 05 minutes 05 seconds east longitude, which is known as the Broadcast Site Hospital Hill NORMANTON, with the Site Identification Number 40354, as identified in the Register of Radiocommunications Licences;
 
Register of Radiocommunications Licences refers to the register established and maintained by the ACMA in accordance with section 143 of the Radiocommunications Act 1992 and the Radiocommunications (Register of Radiocommunications Licences) Determination 1997;
 
Remote Central and Eastern Australia TV1 licence area has the same meaning as in the Licence Area Plan –Remote Central & Eastern Australia Television – December 1996 (as varied from time to time);
 
Remote Central and Eastern Australia TV2 licence area has the same meaning as in the Licence Area Plan –Remote Central & Eastern Australia Television – December 1996 (as varied from time to time); and
 
the Act means the Broadcasting Services Act 1992.
 
4.         Determination
 
4.1       For the purposes of Schedule 4 to the Act, the following areas are local market areas:
 
(a)    the area within the Remote Central and Eastern Australia TV1 licence area and the Remote Central and Eastern Australia TV2 licence area that is within a 15km radius of the Normanton Transmission Site;
 
(b)   the area within the  Remote Central and Eastern Australia TV1 licence area and the Remote Central and Eastern Australia TV2 licence area that is within a 15km radius of the Batchelor Transmission Site;
 
(c)    the area within the Remote Central and Eastern Australia TV1 licence area and the Remote Central and Eastern Australia TV2 licence area that is within a 40km radius of the Jabiru Transmission Site;
 
(d)   the area within the  Remote Central and Eastern Australia TV1 licence area and the Remote Central and Eastern Australia TV2 licence area that is within a 30km radius of the Menindee Transmission Site; and
 
(e)    the area within the  Remote Central and Eastern Australia TV1 licence area and the Remote Central and Eastern Australia TV2 licence area that is within a 10km radius of the Karumba Transmission Site.
 
 
4.2       For the purposes of Schedule 4 to the Act:
 
(a)    the local market area specified under paragraph 4.1(a) is to become a digital-only local market area from and including 01 November 2012;
 
(b)   the local market area specified under paragraph 4.1(b) is to become a digital-only local market area from and including 07 November 2012;
 
(c)    the local market area specified under paragraph 4.1(c) is to become a digital-only local market area from and including 10 November 2012;
 
(d)   the local market area specified under paragraph 4.1(d) is to become a digital-only local market area from and including 29 November 2012; and
 
(e)    the local market area specified under paragraph 4.1(e) is to become a digital-only local market area from and including 29 November 2012.
