Amendments to Guidelines made under section 238-10 of the
Higher Education Support Act 2003
 
 
 
I, Chris Evans, Minister for Tertiary Education, Skills, Science and Research, pursuant to section 238-10 of the Higher Education Support Act 2003 (‘the Act’), make the attached Amendment No. 12 to the Commonwealth Grant Scheme Guidelines No.1, which provide for matters under Part 2-2 and in section 93-10 of the Act.

Amendment No. 12
 
 
 
(i)      CITATION
 
This legislative instrument may be cited as Amendment No. 12 to the Commonwealth Grant Scheme Guidelines No.1
 
(ii)   AUTHORITY
 
This legislative instrument is made under section 238-10 of the Higher Education Support Act 2003 (the Act) to give effect to matters set out in Part 2-2 and Section 93-10 of the Act.
 
(iii)  DATE OF EFFECT
 
This legislative instrument will come into effect on the day after registration on the Federal Register of Legislative Instruments.
 
(iv)  AMENDMENT
 
This legislative instrument amends the Commonwealth Grant Scheme Guidelines No.1   which was registered on 12 December 2006 and which commenced on 13 December 2006 (see F2006L04079).
 
 
ITEM 1
 
Delete the definition of Department or DEEWR in paragraph 1.5.1 and substitute:
 
Department                                      means the Australian Government Department of Industry, Innovation, Science, Research and Tertiary Education   
 
 
ITEM 2
 
Delete paragraph 5.10.5 and substitute:
 
5.10.5         Student load is determined for the medical student loading by using the EFTSL of medical units of study in a course of study in medicine, completion of which would allow provisional registration as a medical practitioner by an authority of a State, a Territory or the Commonwealth (field of education codes (under the Australian Bureau of Statistics Australian Standard Classification of Education) 019901 - medical science and 060100 to 060199 - medical studies, excluding 060113 – Pathology).  The allocation of medical student places for a particular year is equal to the most recent full year student load data reported by the provider through the Student Statistical Data Collection and cleared as final by the Department, plus any new places for a course of study in medicine not yet reported in the Student Statistical Data Collection and specifically allocated to the provider by the Australian Government.
 
 
ITEM 3
 
Delete second occurring paragraph 6.10.5 and substitute:
 
 
6.10.10       The number of EFTSL coded as enabling student load will be that reported in the most recent full year student load data submitted by the higher education provider as part of the student statistics data collection and cleared as final by the Department.
 
 
ITEM 4
 
Delete paragraph 11.3.1 and substitute:
 
 
11.3.1         The amount of transitional loading for mathematics, statistics and science units of study payable to a higher education provider for 2009 will be calculated in accordance with the following formula:

where:
 
A       is the estimated EFTSL of post-2008 mathematics, statistics and science units in 2009, as determined by the Department in consultation with the relevant provider before the end of 2008.  A post-2008 mathematics, statistics and science unit is a unit for which Item 13 of Schedule 2 to the Higher Education Legislation Amendment (2008 Budget Measures) Act 2008 applies.
 
B       is $3,250.
 
 
 
 
ITEM 5
 
Delete paragraph 11.3.2 and substitute:
 
11.3.2         The amount of transitional loading for mathematics, statistics and science units payable to a higher education provider for a year being 2010 or a later year will be calculated in accordance with the following formula:
 
            (A times B) plus (C times D)
 
            where:
 
            A       is the estimated EFTSL of post-2008 mathematics, statistics and science units in that year, as determined by the Department in consultation with the relevant provider. 
 
            B       is the amount shown above for B in 2009, indexed in accordance with the method set out in Part 5-6 of the Act for 2010 and later years.
 
            C       is the difference between the ‘actual EFTSL’ and estimated EFTSL for the preceding year and which may be negative.
 
            D       is the value of B for the preceding year.
 
 
ITEM 6
 
Delete paragraph 11.3.3 and substitute:
 
 
11.3.3        ‘Actual EFTSL’ is the total post-2008 mathematics, statistics and science unit EFTSL for the reporting year as verified by the provider through the student data collection required under subsection 19-70(1) of the Act and accepted by the Department for publication in annual Higher Education Student Statistics.
