I, TANYA PLIBERSEK, Minister of Health, make this determination under regulation 18 of the National Health (Pharmaceutical Benefits) Regulations 1960.

1       Name of Determination
(1)     This Determination is the National Health (Payments for prescriber bag supplies) Determination 2012.
(2)     This Determination may also be cited as PB 92 of 2012.
2       Commencement
This Determination commences on 1 October 2012.
3       Revocation
The Determination under Regulation 18 made on 16 July 1996 is revoked.
4       Definitions
In this Determination:
 
Act means the National Health Act 1953.
 
Commonwealth price has the same meaning as in subsection 84(1) of the Act.
 
practitioner means a medical practitioner, authorised midwife or authorised nurse practitioner.
 
prescriber bag provision has the same meaning as in subsection 84(1) of the Act.
 
special patient contribution has the same meaning as in subsection 84(1) of the Act.
5       Rate of Payment
An approved pharmacist who has supplied a pharmaceutical benefit to a practitioner under a prescriber bag provision of the Act is entitled to be paid by the Commonwealth:
(a)     the Commonwealth price for the particular quantity or number of units of the pharmaceutical benefit ascertained in accordance with the determination under paragraph 98B(1)(a) of the Act which is in force at the time the benefit is supplied; and
(b)     an amount equal to the special patient contribution, if any, for the particular quantity or number of units of pharmaceutical benefit.
6       Payment Conditions
Payment by the Commonwealth to an approved pharmacist for a pharmaceutical benefit supplied to a practitioner under a prescriber bag provision of the Act shall be subject to the conditions set out in the determination under paragraph 98C(1)(b) of the Act which is in force at the time the benefit is supplied, as if the benefit had been supplied other than under a prescriber bag provision of the Act.
