Annual Appropriation Acts
I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:
·                subsection 12(2) of Appropriation Act (No. 2) 2008-2009;
·                subsection 11(2) of Appropriation Act (No. 1) 2010-2011;
·                subsection 13(2) of Appropriation Act (No. 2) 2010-2011; and
·                subsection 11(2) of Appropriation Act (No. 3) 2010-2011.

Part 1                  Preliminary
1                   Name
This Determination is the Determination to Reduce Appropriations (No. 1 of 2012‑2013).
2                   Commencement
This Determination commences on the day on which it is registered.
3                   Legislative authority
(1)   For subsection 12 (2) of Appropriation Act (No. 2) 2008‑2009, subsection 12 (1) of that Act applies to each State, ACT, NT and local government item specified in that Schedule as if the amount specified in an annual report for the item were the amount specified in Schedule 1.
(2)   For subsection 11 (2) of Appropriation Act (No. 1) 2010‑2011, Schedule 2 determines an amount that is taken to be the required amount for the purposes of subsection 11 (1) of that Act and the administered item specified in that Schedule.
(3)   For subsection 13 (2) of Appropriation Act (No. 2) 2010‑2011, Schedule 3 determines an amount by which the administered item specified in that Schedule is to be reduced.
(4)   For subsection 11 (2) of Appropriation Act (No. 3) 2010‑2011, Schedule 4 determines an amount that is taken to be the required amount for the purposes of subsection 11 (1) of that Act and the administered item specified in that Schedule.
4                   Purpose
Schedule 1 to this Determination reduces State, ACT, NT and local government items for the Department of Health and Ageing by the amount indicated in column 5. The required amount in column 4 for the State, ACT, NT and local government items can apply as if it is the amount specified in the Department of Health and Ageing’s annual report.
Schedules 2 and 4 to this Determination reduce administered items for the Department of Health and Ageing by the amount indicated in column 5. The required amount in column 4 for the administered items can apply as if it is the amount specified in the Department of Health and Ageing’s annual report.
Schedule 3 to this Determination reduces the other departmental item (Equity Injections) for the Department of Health and Ageing by the amount indicated in column 4.
 
5                   Disallowance
This Determination is a Legislative Instrument and is disallowable.
Note      Section 42 (disallowance) of the Legislative Instruments Act applies to this Determination (despite subsection 44(2) of that Act which exempts certain legislative instruments from disallowance).  However, Part 6 (sunsetting) of the Legislative Instruments Act 2003 does not apply to this Determination.
