BASS STRAIT CENTRAL ZONE SCALLOP FISHERY (Closures) DIRECTION No. 1 2012
                                                                                                                                                           
 
I, James Findlay, Chief Executive Officer of the Australian Fisheries Management Authority, as delegate under delegation No. 1 of 2011 made on 28th January 2011 from the Commission, make the following Direction under subsection 41A(2) of the Fisheries Management Act 1991.

Citation
1.      This Direction may be cited as the Bass Strait Central Zone Scallop Fishery (Closures) Direction No. 1 2012.
Commencement
2.      This Direction commences on 22 August 2012.
Cessation
3.   This Direction ceases to have effect as if repealed on 31 December 2013 unless earlier revoked.
Interpretation
4.   Terms used in this Direction that are defined for the purposes of the Bass Strait Central Zone Scallop Fishery Management Plan 2002 (the Plan) have the same meanings in this Direction as they have in the Plan.
Notes:             1.    Terms defined in the Fisheries Management Act 1991 have the same meanings in this Direction.
To Whom This Direction Applies
5.   This Direction applies to a holder of a fishing concession in the Bass Strait Central Zone Scallop Fishery and to a person acting on behalf of the holder.
 
[Note: This means that the Direction does not apply to a person if the person is fishing in the area of the Fishery in accordance with a fishing concession that is subject to another plan of management in force under the Act, under a scientific permit, a permit issued in another fishery, or under a licence issued under a law of a State or Territory.]
Direction Not to Engage in Fishing
 6.  Fishing is not to be engaged in in the Bass Strait Central Zone Scallop Fishery.
Exemption to the Prohibition in Clause 6
7.   Until 31 January 2013, the prohibition in clause 6 does not apply to the following area of water in the Bass Strait Central Zone Scallop Fishery:
 
The area of waters contained within and bounded by a line:
                            i.      Commencing at the point of intersection of the parallel of latitude 39° 56¢ 00² South and the meridian of longitude 150° 25¢ 00² East;
                          ii.      north along that meridian to its intersection with the boundary between the adjacent areas in relation to Victoria and New South Wales;
                        iii.      north-westerly along that boundary to its intersection with the outer limit of the coastal waters of Victoria;
                        iv.      generally south-westerly along that outer limit to its intersection with the meridian 149° 59¢ 00² East;
                          v.      south along that meridian to a point 20 nautical miles seaward of the nearest point of the baseline from which the coastal waters of Victoria are measured;
                        vi.      generally south-westerly along the line, every point on which is 20 nautical miles seaward of the nearest point of the baseline from which the coastal waters of Victoria are measured, to its intersection with the parallel 39° 00¢ 00² South;
                      vii.      west along that parallel to its intersection with the outer limit of the coastal waters of Victoria east of Wilson’s Promontory;
                    viii.      generally southerly along that outer limit to its intersection with the boundary between the adjacent areas in relation to Victoria and Tasmania;
                        ix.      west along that boundary to its westernmost intersection with the outer limit of the coastal waters of Victoria;
                          x.      generally northerly and westerly along that outer limit to its intersection with the meridian 146° 00¢ 00² East;
                        xi.      south along that meridian to a point 20 nautical miles seaward of the nearest point of the baseline from which the coastal waters of Tasmania are measured;
                      xii.      generally easterly along the line, every point on which is 20 nautical miles seaward of the baseline from which the coastal waters of Tasmania are measured;
                    xiii.      generally easterly along that line to its intersection north of Tasmania with the meridian 146° 47¢ 00² East;
                    xiv.      south-easterly along the geodesic to 40° 37¢ 00² South, 146° 59¢ 00² East;
                      xv.      north-easterly along the geodesic to 40° 30¢ 00² South, 147° 16¢ 00² East;
                    xvi.      north-easterly along the geodesic to 40° 29¢ 00² South, 147° 25¢ 00² East;
                  xvii.      north-westerly along the geodesic to 40° 18¢ 00² South, 147° 22¢ 00² East;
                xviii.      north-westerly along the geodesic to 40° 04¢ 00² South, 147° 19¢ 00² East;
                    xix.      north along the meridian 147° 19¢ 00² East to its intersection with the parallel 39° 53¢ 00² South;
                      xx.      north-easterly along the geodesic to 39° 36¢ 00² South, 147° 32¢ 00² East;
                    xxi.      south-easterly along the geodesic that runs through 39° 44¢ 00² South, 147° 51¢ 00² East to its intersection with the outer limit of coastal waters adjacent to, and north-west of, Flinders Island;
                  xxii.      generally north-easterly and south-easterly along that outer limit to its intersection east of Flinders Island with the parallel 39° 56¢ 00² South;
                xxiii.      east along that meridian 39° 56¢ 00² South to the point of commencement;
but excluding all areas that are part of the coastal waters of Tasmania or Victoria.
Revocation of Previous Direction
8.  This Direction revokes Bass Strait Central Zone Scallop Fishery (Closures) Direction No.3 2011 with effect from the commencement of this Direction.
