I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subclause 5F(1) of Schedule 4 to the Broadcasting Services Act 1992.

1.         Name of Determination
 
This Determination is the Broadcasting Services (Digital-Only Local Market Areas for the Remote and Regional WA TV1, Western Zone TV1 and Kalgoorlie TV1 Licence Areas) Determination (No. 1) 2012.
 
2.         Commencement
 
This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.
 
3.         Definitions
 
In this Determination:
 
digital-only local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
Esperance Transmission Site is the location at 33 degrees 52 minutes 34 seconds south latitude and 121 degrees 53 minutes 35 seconds east longitude, which is known as the Telstra/NTA Site Wireless Hill, Esperance, with the Site Identification Number 30253, as identified in the Register of Radiocommunications Licences;
 
Kalgoorlie TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
 
Kununurra Transmission Site is the location at 15 degrees 45 minutes 52 seconds south latitude and 128 degrees 44 minutes 21 seconds east longitude, which is known as the Broadcast Site Kellys Knob, Kununurra, with the Site Identification Number 151801, as identified in the Register of Radiocommunications Licences;
 
local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
Register of Radiocommunications Licences refers to the register established and maintained by the Australian Communications and Media Authority in accordance with section 143 of the Radiocommunications Act 1992 and the Radiocommunications (Register of Radiocommunications Licences) Determination 1997;
 
Remote and Regional WA TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
 
the Act means the Broadcasting Services Act 1992; and
 
Western Zone TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act.
 
 
 
4.         Determination
 
4.1       For the purposes of Schedule 4 to the Act, the following areas are local market areas:
 
(a)    the area within the Remote and Regional WA TV1, Western Zone TV1 and Kalgoorlie TV1 licence areas that is within a 60km radius of the Esperance Transmission Site; and
 
(b)   the area within the Remote and Regional WA TV1 and Western Zone TV1 licence areas that is within a 40km radius of the Kununurra Transmission Site.
 
 
 
 
 
4.2       For the purposes of Schedule 4 to the Act:
 
(a)    the local market area specified under paragraph 4.1(a) is to become a digital-only local market area from and including 29 August 2012; and
 
(b)   the local market area specified under paragraph 4.1(b) is to become a digital-only local market area from and including 22 August 2012.
