1              Name of Determination
                 This Determination is the Aged Care (Amount of Flexible Care Subsidy — Innovative Care Service — Congress Community Development and Education Unit Ltd) Determination 2012 (No. 1).
2                      Commencement and Cessation
                 This Determination commences on 1 July 2012 and ceases to have effect on 31 December 2012.

3              Revocation
                The Aged Care (Amount of Flexible Care Subsidy – Innovative Care Service – Congress Community Development and Education Unit) Amendment Determination 2011 made by the Minister on 18 July 2011, also known as F2011L01532, is revoked.
4              Definition
In this Determination:
 
Approved Provider means Congress Community Development and Education Unit Ltd.
 
Eligible flexible care means flexible care in the form of innovative care provided in a residential setting at the Dija Meta Aged and Disabled Hostel operated by the Approved Provider at 269 Hartley Street CAIRNS QLD 4870.
5              Amount of flexible care subsidy
(1)   This Determination applies to a care recipient receiving care of a kind specified in section 15.24 of the Flexible Care Subsidy Principles 1997 provided by the Approved Provider in a residential setting at Dija Meta Aged and Disabled Hostel in accordance with the joint initiative between the Department of Health and Ageing and the Approved Provider.
 
(2)   Subject to subsection 50‑1(2) of the Aged Care Act 1997, the amount of flexible care subsidy that is payable on and from 1 July 2012 for each care recipient to whom the approved provider provides eligible flexible care in respect of a day is the amount worked out in accordance with the following formula:

where n is the number of care recipients receiving eligible flexible care on that day, but is a minimum of one care recipient and no more than 12 care recipients.
