SPECIFICATION OF AN ASSESSING BODY FOR CERTAIN EDUATIONAL QUALIFICATIONS
(Paragraph 6C76(b) and 2.26AC(5)(b))
 
 
I, CHRIS BOWEN, Minister for Immigration and Citizenship, acting under paragraph 6C76(b) of Part 6C.7 of Schedule 6C and paragraph 2.26AC(5)(b) to the Migration Regulations 1994 (‘the Regulations’)
 
1.        REVOKE Instrument number IMMI 11/037 signed on 16 June 2011 specifying an assessing authority for the purposes of paragraph 6C76(b); AND
2.        SPECIFY for the purposes of paragraphs 6C76(b) and 2.26AC(5)(b), Vocational Education Training and Assessment Services (VETASSESS) as an assessing authority.
 
 
This Instrument number IMMI 12/019, commences on 1 July 2012, immediately after the commencement of Migration Amendment Regulation 2012 (No. 2).

[NOTE 1:    Item 6C76 of the Regulations provides that, for items 6C71 and 6C72, for the purpose of being satisfied that a qualification is of a recognised standard, the Minister must have regard to whether the qualification has been recognised by the relevant assessing authority for the applicant’s nominated skilled occupation as being suitable for the occupation; whether the qualification has been recognised by another body, specified by the Minister in an instrument in writing and any other matter relevant to the consideration of the qualification, including the duration of the applicant’s study.
NOTE 2:     Item 6C71 of the Regulations provides that an applicant has met the requirements for the award of a doctorate by an Australian educational institution, or the award of a doctorate, by another educational institution, that the Minister is satisfied is of a recognised standard.
NOTE 3:     Item 6C72 of the Regulations provides that an applicant has met the requirements for the award of at least a bachelor degree by an Australian educational institution, or the award of at least a bachelor degree by another educational institution, that the Minister is satisfied is of a recognised standard
NOTE 4:     Paragraph 2.26AC(5)(b) of the Regulations provides that, for items 6D71 and 6D72, in determining whether an educational qualification is of a recognised standard, the Minister must have regard to whether the educational qualification is recognised by a body specified by the Minister in an instrument in writing.]
