1 Name of regulation
This regulation is the Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Amendment Regulation 2012 (No. 1).
2 Commencement
This regulation commences on 1 July 2012.
3 Amendment of Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Regulations 2004
Schedule 1 amends the Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Regulations 2004.

(1) For subsection 2B (1) of the Act, the value is the global warming potential amount in the following table for a kind of SGG.

(2) If an SGG is composed of more than one kind of SGG, for each component that is specified in the table:
(a) the value is worked out separately; and
(b) the value is the amount specified in the table for the component.
Example R410A is composed of 50% of HFC-32 and 50% of HFC-125. If a person imports 1 kilogram of R410A, the SGG amount in metric tonnes of the component will be 50% multiplied by 0.001, multiplied by the value for the component HFC-32 specified (650) (which equals 0.325 tonnes), plus 50% multiplied by 0.001, multiplied by the value for the component HFC‑125 specified (2 800) (which equals 1.4 tonnes) to equal the carbon dioxide equivalence of 1.725 tonnes for the 1 kilogram of R410A.
6 Manufacture levy rate—SGGs
For the definition of prescribed rate in subsection 3A (5) of the Act, the rate is $165 per tonne.
7 Manufacture levy rate—substances other than SGGs
For subsection 4 (1) of the Act, the following rates of levy are prescribed:
(a) for HCFCs—$3 000 per ODP tonne;
(b) for methyl bromide—$135 per tonne.
