I, STEPHEN CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under paragraph 51(1)(c) of the Telecommunications Act 1997.

1        Name of Determination
 
This Determination is the Telecommunications (Carrier Licence Exemption) Determination 2012 (No. 2).
 
2        Commencement
 
This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.
 
3        Definitions
 
In this Determination:
 
Act means the Telecommunications Act 1997.
 
Ausgrid means Ausgrid Pty Ltd (ABN 39 060 979 688), a statutory corporation constituted under the Energy Services Corporations Act 1995 (NSW).
 
Ausgrid Communications Infrastructure means telecommunications infrastructure owned by Ausgrid which is situated in New South Wales.
 
Hunter Water means Hunter Water Corporation (ABN 46 228 513 446), a State Owned Corporation established under the Hunter Water Act 1991 (NSW).
 
Permitted Smart Metering Services means a carriage service that is:
(a)   provided to:
(i)               Hunter Water; or
(ii)            Sydney Water; or
(iii)                       a wholly owned subsidiary of Hunter Water; or
(iv)                       a wholly owned subsidiary of Sydney Water; and
(b)   necessary or desirable for managing the distribution of water and sewage in a pipeline or charging for the supply of water distributed in a pipeline.
 
Sydney Water means Sydney Water Corporation (ABN 49 776 225 038), a State Owned Corporation established under the Sydney Water Corporation Act 1994 (NSW).
 
 
Note:               In this Determination, the term carriage service has the same
meaning given by section 7 of the Act (see subsection 13(1) of the Legislative Instruments Act 2003 (Cth)).
4        Exemption
 
Section 42 of the Act does not apply in relation to the use by Ausgrid of the Ausgrid Communications Infrastructure for the supply of Permitted Smart Metering Services.
 
5        Cessation
 
This Determination ceases to have effect on 30 June 2015.
