Financial Management and Accountability Act 1997
I, TIM YOUNGBERRY, First Assistant Secretary, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under subsection 32(2) of the Financial Management and Accountability Act 1997 (the FMA Act).
 
This Determination is made due to a decision of the Australian Government to transfer responsibility of the National Mental Health function from the Department of the Prime Minister and Cabinet to the National Mental Health Commission; and the development of the National Report Card from the Department of Health and Ageing to the National Mental Health Commission.

1              Name of Determination
This Determination is the Financial Management and Accountability Act 1997 Determination 2012/08 — Section 32 (Transfer of Functions from DPMC and HEALTH to NMHC).
Note 1: This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation in accordance with section 62 of the FMA Act. The Secretary has delegated his power in accordance with section 53 of the FMA Act.
Note 2: Acronyms used in this Determination are as follows:
(a)       “DPMC” – refers to the Department of the Prime Minister and Cabinet.
(b)       “HEALTH” – refers to the Department of Health and Ageing
(c)        “NMHC” – refers to the National Mental Health Commission.
Note 3: The NMHC was established as an Executive Agency on 1 January 2012. Responsibility for the National Mental Health function was then transferred to NMHC from DPMC. In addition, responsibility for development of the National Report Card has been transferred from HEALTH to NMHC.
2              Commencement
This Determination commences on the day on which it is made.
3              Amendment of Appropriation Act (No. 1) 2011-2012
                Schedule 1 amends Appropriation Act (No. 1) 2011-2012 to:
(a)    reduce the administered item alongside Outcome 11 for HEALTH by $450,000.00;
(b)   reduce the departmental item for DPMC by $787,559.00;
(c)    reduce the administered item alongside Outcome 1 for DPMC by $1,531,000.00;
(d)   increase the departmental item for NMHC by $787,559.00; and
(e)    increase the administered item alongside Outcome 1 for NMHC by $1,981,000.00.
 
4              Amendment of Appropriation Act (No. 2) 2011-2012
                Schedule 2 amends Appropriation Act (No. 2) 2011-2012 to:
(a)    reduce the departmental non-operating item for DPMC by $171,722.00; and
(b)   increase the departmental non-operating item for NMHC by $171,722.00.

Note 2: Financial Management and Accountability Act 1997 Determination 2011/16 (Transfer of Functions from HEALTH to ANPHA) amended the amount alongside Outcome 1 under the heading “Administered” to transfer an amount to the Australian National Preventive Health Agency.
On 28 June 2011 the National Binge Drinking Strategy (NBDS) expansion function was transferred from the Department of Health and Ageing to the Australian National Preventive Health Agency.
Note 3: Financial Management and Accountability Act 1997 Determination 2012/01 (Transfer of functions from HEALTH to ANPHA) amended the amount alongside Outcome 1 under the heading “Administered” to transfer an amount to the Australian National Preventive Health Agency.
On 26 September 2011 the development and management of the National Healthy Workplace Employer Awards within the Healthy Workers Initiative, under the National Partnership Agreement was transferred to the Australian National Preventive Health Agency.
Note 4: Financial Management and Accountability Act 1997 Determination 2012/08 (Transfer of functions from DPMC and HEALTH to NMHC) amended the amount alongside Outcome 11 under the heading “Administered” to transfer an amount to the National Mental Health Commission.
The National Mental Health Commission was established as an Executive Agency on
1 January 2012. Responsibility for the National Mental Health function was then transferred to the National Mental Health Commission from the Department of the Prime Minister and Cabinet. In addition, responsibility for development of the National Report Card has been transferred from HEALTH to NMHC.

On 14 September 2010 the arts and culture functions were transferred from the Department of Sustainability, Environment, Water, Population and Communities to the Department of the Prime Minister and Cabinet.
Note 3: Financial Management and Accountability Act 1997 Determination 2011/07 — Section 32 (Transfer of Functions from the former DEWHA to DPMC) amended the amount alongside Outcome 2 under the heading “Administered Expenses”, to transfer an amount from the former Department of the Environment, Water, Heritage and the Arts.
Note 4: Financial Management and Accountability Act 1997 Determination 2011/08 – Section 32 (Transfer of Functions from FHCSIA to DPMC) amended an amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental Outputs”, to transfer an amount from the Department of Families, Housing, Community Services and Indigenous Affairs.
Note 5:       Financial Management and Accountability Act 1997 Determination 2011/10 – Section 32 (Transfer of Functions from the former DEWHA to DPMC) amended the amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental Outputs”, to transfer an amount from the former Department of the Environment, Water, Heritage and the Arts.
Note 6:      Financial Management and Accountability Act 1997 Determination 2011/11 — Section 32 (Transfer of Functions from Health to DPMC) added “Outcome 3” and, alongside Outcome 3, an amount under the heading “Administered Expenses”, to transfer an amount from the Department of Health and Ageing.
Note 7: Financial Management and Accountability Act 1997 Determination 2011/13 — Section 32 (Transfer of Functions from DPMC to DBCDE) amended the amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental”, to transfer an amount to the Department of Broadband, Communications and the Digital Economy.

Note 9: Financial Management and Accountability Act 1997 Determination 2012/03 — Section 32 (Transfer of Functions from DPMC to DRALGAS) amended the amount alongside Outcome 2 under the heading “Administered Expenses”, to transfer an amount from the Department of the Prime Minister and Cabinet to the Department of Regional Australia, Local Government, Arts and Sport, due to a change to the Administrative Arrangements Order with effect from 14 December 2011.
Note 10: Financial Management and Accountability Act 1997 Determination 2012/04 – Section 32 (Transfer of Functions from DPMC to DEFENCE) amended an amount in this table alongside “Total: Department of the Prime Minister and Cabinet” in the
“Departmental” column, to transfer an amount to Department of Defence.
Functions relating to the National Security Grants Program were transferred from the Department of the Prime Minister and Cabinet to the Department of Defence due to a change to the Administrative Arrangements Order on 14 December 2011.
Note 11: Financial Management and Accountability Act 1997 Determination 2012/05 — Section 32 (Transfer of Functions from AGD to DPMC) amended the amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental”, to transfer an amount from the departmental item of the Attorney-General’s Department to the Department of the Prime Minister and Cabinet.
Note 12: Financial Management and Accountability Act 1997 Determination 2012/11 — Section 32 (Transfer of Functions from AGD to DPMC) amended the amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental”, to transfer an amount from the departmental item of the Attorney-General’s Department to the Department of the Prime Minister and Cabinet.
The functions relating to Cyber Security policy coordination were transferred from the
Attorney-General’s Department to the Department of the Prime Minister and Cabinet due to a change in the Administrative Arrangements Order with effect from 14 December 2011.
Note 13: Financial Management and Accountability Act 1997 Determination 2012/08— Section 32 (Transfer of Functions from DPMC to NMHC) amended:
(a)                an amount alongside “Total: Department of the Prime Minister and Cabinet” under the heading “Departmental”, to transfer an amount from the Department of the Prime Minister and Cabinet to the National Mental Health Commission; and
(b)                an amount alongside Outcome 1 under the heading “Administered” to transfer an amount from the Department of the Prime Minister and Cabinet to the National Mental Health Commission.
