Broadcasting Services (Digital-Only Local Market Area for the Southern New South Wales TV1 Licence Area) Determination (No.1) 2012
 
 
 
I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subclause 5F(1) of Schedule 4 to the Broadcasting Services Act 1992.

1.         Name of Determination
 
This Determination is the Broadcasting Services (Digital-Only Local Market Area for the Southern New South Wales TV1 Licence Area) Determination (No. 1) 2012.
 
2.         Commencement
 
This Determination commences on the day it is registered on the Federal Register of Legislative Instruments.
 
3.         Definitions
 
In this Determination:
 
digital-only local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
 
Register of Radiocommunications Licences refers to the register established and maintained by the Australian Communications and Media Authority in accordance with section 143 of the Radiocommunications Act 1992 and the Radiocommunications (Register of Radiocommunications Licences) Determination 1997;
 
Southern New South Wales TV1 licence area is the area determined by the Australian Communications and Media Authority in the Licence Area Plan - Southern NSW Analog Television made under subsection 26(1) of the Act;
 
the Act means the Broadcasting Services Act 1992; and
 
Thredbo Transmission Site is the location at 36 degrees 29 minutes 41 seconds south latitude and 148 degrees 17 minutes 10 seconds east longitude, which is known as Eagles Nest Restaurant, Mt Crackenback, with the Site Identification Number 9734, as identified in the Register of Radiocommunications Licences.
 
 
4.         Determination
 
4.1       For the purposes of Schedule 4 to the Act, the area within the Southern New South Wales TV1 licence area that is within a 10km radius of the Thredbo Transmission Site is a local market area.
 
4.2       For the purposes of Schedule 4 to the Act, the local market area specified under subclause 4.1 is to become a digital-only local market area from and including
17 April 2012.
