15A.1  Name of principles
                   These principles are the Home Care Subsidy Principles 2013.
15A.2  Commencement
                   These principles commence on 1 August 2013.
15A.3  Authority
                   These principles are made under the Aged Care Act 1997.
15A.4  Definition
                   In these principles:
Act means the Aged Care Act 1997.
Note:          A number of expressions used in these principles are defined in the Act, including home care agreement.
15A.5  Suspension of home care
             (1)  This section applies, for the purposes of Part 3.2 of the Act, if the provision of home care to a care recipient in accordance with a home care agreement is suspended, on a temporary basis, under section 46‑2 of the Act in accordance with a request made under subsection 46‑2(1) of the Act.
             (2)  The home care agreement (as in force on the commencement date specified in the request) is taken to remain in force during the period for which the provision of home care is suspended (the suspension period).
             (3)  The care recipient is taken to have been provided with home care, as required by the home care agreement, on each day of the suspension period.
             (4)  The suspension period:
                     (a)  includes the commencement date mentioned in subsection (2); but
                     (b)  does not include the day on which the approved provider recommences, or commences, providing home care to the care recipient.
15A.6  Amounts of advances of home care subsidy
                   For subsection 47‑3(4) of the Act, amounts of advances must be worked out by taking into account only care recipients who are being provided with home care in accordance with a home care agreement.
