FMA Act Determination 2013/05 — Section 32 (Transfer of Functions from DCCEE to DIICCSRTE and DRET)
Financial Management and Accountability Act 1997
I, ALAN GREENSLADE, First Assistant Secretary, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under section 32 of the Financial Management and Accountability Act 1997 (FMA Act), as delegate of the Secretary of the Department of Finance and Deregulation, who, in turn, is a delegate of the Finance Minister.
 
This Determination is made due to amendments to the Administrative Arrangements Order, made on 25 March 2013. On that day, the Department of Climate Change and Energy Efficiency (DCCEE) was abolished and its functions were transferred:
•         in relation to climate change, to the Department of Industry, Innovation, Climate Change, Science, Research and Tertiary Education (DIICCSRTE); and
•         in relation to energy efficiency, to the Department of Resources, Energy and Tourism (DRET).

1  Name of Determination
                   This Determination is the FMA Act Determination 2013/05 — Section 32 (Transfer of Functions from DCCEE to DIICCSRTE and DRET).
2  Commencement
                   This Determination commences on 28 June 2013.
3  Purpose
                   The purpose of this Determination is to further adjust appropriations in relation to amendments made to the Administrative Arrangements Order on 25 March 2013. On that day, DCCEE was abolished and its functions were transferred:
•          in relation to climate change, to DIICCSRTE; and
•          in relation to energy efficiency, to DRET.
Note 1: Functions in relation to climate change were transferred from DCCEE to DIICCSRTE, and functions in relation to energy efficiency were transferred from DCCEE to DRET due to a change in the Administrative Arrangements Order with effect from 25 March 2013.
Note 2: This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is, in turn, a delegate of the Finance Minister (in accordance with section 62 of the FMA Act) and the Secretary has sub-delegated that power to the signatory of this Determination (in accordance with section 53 of the FMA Act).
Note 3: An initial transfer of appropriations relating to the transfer of functions in relation to the  Administrative Arrangements Order on 25 March 2013 occurred under FMA Act Determination 2013/01– Section 32 (Transfer of Functions from DCCEE to DIICCSRTE and DRET). This Determination relates to the second transfer of appropriations. 
4  Amendment of Appropriation Acts
                   Schedule 1 of Appropriation Act (No. 1) 2012-2013 is amended as set out in Schedule 1 to this Determination.
                   Schedule 2 of Appropriation Act (No. 2) 2012-2013 is amended as set out in Schedule 2 to this Determination.
                   Schedule 1 of Appropriation Act (No. 3) 2012-2013 is amended as set out in Schedule 3 to this Determination.
                   Schedule 1 of Appropriation Act (No. 1) 2011-2012 is amended as set out in Schedule 4 to this Determination.
                   Schedule 2 of Appropriation Act (No. 2) 2011-2012 is amended as set out in Schedule 5 to this Determination.
                   Schedule 1 of Appropriation Act (No. 3) 2011-2012 is amended as set out in Schedule 6 to this Determination.
                   Schedule 2 of Appropriation Act (No. 2) 2010-2011 is amended as set out in Schedule 7 to this Determination.
                   Schedule 2 of Appropriation Act (No. 4) 2010-2011 is amended as set out in Schedule 8 to this Determination.
5  Definitions
                   In this Determination:
DCCEE means the former Department of Climate Change and Energy Efficiency.
DIICCSRTE means the Department of Industry, Innovation, Climate Change, Science, Research and Tertiary Education.
DIISRTE means the former Department of Industry, Innovation, Science, Research and Tertiary Education.
DIISR means the former Department of Innovation, Industry, Science and Research.
DRET means the Department of Resources, Energy and Tourism.
FMA Act means the Financial Management and Accountability Act 1997.
Schedule 1   Amendment of Appropriation Act (No. 1) 2012‑2013
1     At the end of Schedule 1, after the note to Table 3 for
“3 FMA Act Determination 2013/04 – Section 32 (Transfer of Functions
from Health to NHFB)”

4    FMA Act Determination 2013/05 — Section 32 (Transfer of Functions   from DCCEE to DIICCSRTE and DRET)
Schedule 1 of this Act is amended in accordance with section 32 of the Financial Management and Accountability Act 1997 (FMA Act). Amendments to appropriations are as specified in the following table. The appropriation item (listed in Column 1) for the Agency (listed in Column 2) is amended by the relevant amount (listed in Column 3).
A positive amount in Column 3 is an increase in the appropriation and a negative amount is a decrease in the appropriation.

Insert:
Note 2:       FMA Act Determination 2013/05 — Section 32 (Transfer of Functions from DCCEE to DIICCSRTE and DRET) reduced the departmental item for the former Department of Climate Change and Energy Efficiency (DCCEE) in accordance with Table 4 at the end of Schedule 1 to this Act.
These changes were made to implement the amendments to the Administrative Arrangements Order made on 25 March 2013. Functions of the former DCCEE were transferred:
(a)                 in relation to climate change, to the Department of Industry, Innovation, Climate Change, Science, Research and Tertiary Education; and
(b)                 in relation to energy efficiency, to the Department of Resources, Energy and Tourism.
