Exemptions — applicable to Part 42 aircraft
1          Duration
                 This instrument:
(a)   commences on the day after registration; and
(b)   expires at the end of 26 June 2016, as if it had been repealed by another instrument.
2          Definitions
                 In this instrument:
CAR 1988 means the Civil Aviation Regulations 1988.
Part 42 aircraft means an aircraft referred to in paragraph 202.180 (1) (a) of CASR 1998.
3          Application
                 This instrument applies to:
(a)   each person carrying out maintenance on a Part 42 aircraft to whom requirements of CAR 1988 would otherwise apply; and
(b)   the holder of the certificate of registration, operator and pilot in command of a Part 42 aircraft to whom requirements of CAR 1988 would otherwise apply.
4          Exemption from regulation 42U
                 A person mentioned in regulation 42.295 of CASR 1998, who is modifying or repairing a Part 42 aircraft, is exempt from compliance with regulation 42U of CAR 1988.
5          Exemption from regulation 42V
                 A person mentioned in regulation 42.295 or 42.300 of CASR 1998, who is carrying out maintenance on a Part 42 aircraft, is exempt from compliance with regulation 42V of CAR 1988.
6          Exemption from regulation 42W
                 A person mentioned in regulation 42.295 or 42.300 of CASR 1998, who is carrying out maintenance on a Part 42 aircraft, is exempt from compliance with subregulations 42W (2) and (4) of CAR 1988.
7          Exemption from regulation 42X
                 A person mentioned in regulation 42.295 or 42.300 of CASR 1998, who is carrying out maintenance on a Part 42 aircraft, is exempt from compliance with regulation 42X of CAR 1988.
8          Exemption from regulation 42ZA
                 The holder of the certificate of registration for, the operator of, and the pilot in command of, a Part 42 aircraft that is outside Australian territory are exempt from compliance with regulation 42ZA of CAR 1988.
9          Exemption from subregulation 42ZC (1)
                 The holder of the certificate of registration for, the operator of, and the pilot in command of, of a Part 42 aircraft that is inside Australian territory are exempt from compliance with subregulation 42ZC (1) of CAR 1988 if the maintenance is carried out by a person mentioned in regulation 42.295 or 42.300 of CASR 1998.
10        Exemption from subregulation 42ZD (1)
                 The holder of the certificate of registration for, the operator of, and the pilot in command of, a Part 42 aircraft that is outside Australian territory are exempt from compliance with subregulation 42ZD (1) of CAR 1988 if the maintenance is carried out by a person mentioned in regulation 42.295 or 42.300 of CASR 1998.
11        Exemption from subregulation 42ZE (1)
                 A person mentioned in regulation 42.295 or 42.300 of CASR 1998 who has carried out maintenance on a Part 42 aircraft in Australian territory is exempt from compliance with subregulation 42ZE (1) of CAR 1988.
12        Exemption from subregulation 42ZN (1)
                 The holder of the certificate of registration for a Part 42 aircraft on which maintenance has been carried out outside Australian territory is exempt from compliance with subregulation 42ZN (1) of CAR 1988 if the maintenance is carried out by a person mentioned in regulation 42.295 or 42.300 of CASR 1998.
13        Exemption from subregulation 42ZV (1)
                 The operator of a Part 42 aircraft is exempt from compliance with
subregulation 42ZV (1) of CAR 1988.
14        Exemption from subregulations 42ZY (1), (2) and (3)
                 The operator of a Part 42 aircraft is exempt from compliance with subregulations 42ZY (1), (2) and (3) of CAR 1988.
15        Exemption from subregulation 43B (1)
                 The owner, operator and pilot in command of a Part 42 aircraft are exempt from compliance with subregulation 43B (1) of CAR 1988.
16        Exemption from subregulation 50 (2)
                 The holder of the certificate of registration for, the operator of, and the flight crew members of, a Part 42 aircraft are exempt from compliance with subregulation 50 (2) of CAR 1988.
17        Exemption from subregulation 50A (1)
                 The holder of the certificate of registration for a Part 42 aircraft is exempt from compliance with subregulation 50A (1) of CAR 1988.
18        Exemption from paragraph 139 (1) (c)
                 The pilot in command of a Part 42 aircraft is exempt from compliance with paragraph 139 (1) (c) of CAR 1988.
19        Exemption from subregulation 214 (1)
                 The operator of a Part 42 aircraft, who is using a Part 145 organisation to carry out maintenance on that aircraft is, exempt from compliance with
subregulation 214 (1) of CAR 1988 in respect of employees of the Part 145 organisation.
