Part 42 Manual of Standards Amendment Instrument 2013 (No. 1)
1          Name of instrument
                 This instrument is the Part 42 Manual of Standards Amendment Instrument 2013 (No. 1).
2          Commencement
                 This instrument commences on the day after registration.

                 Schedule 1 amends the Part 42 Manual of Standards Instrument 2011.

Carrying out maintenance on Australian aircraft outside Australian territory
6.1       Introduction
    6.1.1     Under regulation 42.301 of CASR 1998, an organisation is permitted to carry out maintenance outside Australian territory on an Australian aircraft to which Part 42 applies if certain conditions are met.
    6.1.2     Under paragraph 42.301 (1) (a) of CASR 1998, the organisation must be approved to carry out the maintenance by the National Airworthiness Authority (NAA) of a foreign country under the law of that country.
    6.1.3     Under paragraph 42.301 (1) (b) of CASR 1998, the country must be specified for regulation 42.301 of CASR 1998 in the Part 42 Manual of Standards.
    6.1.4     In accordance with paragraph 42.301 (1) (b) of CASR 1998, this Chapter contains a list of those countries.
Note   There are other requirements to be met before the maintenance can be carried out and certified.
Under paragraph 42.301 (1) (c) of CASR 1998, there must be an arrangement between CASA and the NAA to permit the organisation to carry out the maintenance (the NAA arrangement).
Under subregulation 42.301 (2) of CASR 1998, the organisation must carry out and certify the maintenance in accordance with the NAA arrangement between CASA and the NAA.

Carrying out maintenance on an aeronautical product for an Australian aircraft outside Australian territory
7.1       Introduction
    7.1.1     Under regulation 42.306 of CASR 1998, an organisation is permitted to carry out maintenance outside Australian territory on an aeronautical product for an Australian aircraft to which Part 42 applies if certain conditions are met.
    7.1.2     Under paragraph 42.306 (1) (a) of CASR 1998, the organisation must be approved to carry out the maintenance by the NAA of a foreign country under the law of that country.
    7.1.3     Under paragraph 42.306 (1) (b) of CASR 1998, the country must be specified for regulation 42.306 in the Part 42 Manual of Standards.
    7.1.4     In accordance with paragraph 42.306 (1) (b) of CASR 1998, this Chapter contains a list of those countries.
Note   There are other requirements to be met before maintenance on an aeronautical product can be carried out and certified.
Under subregulation 42.306 (2) of CASR 1998, the organisation must carry out and certify the maintenance in accordance with an arrangement between CASA and the NAA, or under the law of the foreign country that granted the approval to carry out the maintenance.
