1          Name of Order
                 This Order is Marine Order 63 (MASTREP) 2013.
2          Commencement
                 This Order commences on 1 July 2013.
3          Purpose
        (1)     This Order gives effect to:
(a)   Regulation 11 of Chapter V of SOLAS; and
(b)   Chapter 5 of the Annex to the International Convention on Maritime Search and Rescue, 1979; and
(c)   Division 4 of Part 6 of Chapter 6 of the Navigation Act.
        (2)     This Order establishes a system for the reporting of the movement of vessels in the MASTREP area.
4          Definitions
                 In this Order:
AIS means the automatic identification system required by Regulation 19.2.4 of Chapter V of SOLAS to be fitted on a vessel.
MASTREP means the Modernised Australian Ship Tracking and Reporting System established by this Order.
MASTREP area means the area mentioned in Schedule 2.
RCC Australia means the AMSA Rescue Coordination Centre responsible for coordinating search and rescue across the Australian search and rescue region.
REEFVTS means the navigational service known as the Great Barrier Reef and Torres Strait Vessel Traffic Service operated jointly by AMSA and Maritime Safety Queensland.

5          Application
                 This Order applies to the each of the following vessels while in the MASTREP area:
(a)   a regulated Australian vessel;
(b)   a foreign vessel from its arrival at its first port in Australia until its departure from its final port in Australia.
Note   The MASTREP system helps AMSA to carry out its functions in searches and rescues. For this reason, domestic commercial vessels fitted with GMDSS and AIS are also encouraged to participate in it whenever they are in the MASTREP area, even when it is not mandatory for them to do so.
6          Reporting requirements
        (1)     For subsection 221(1) of the Navigation Act, the master of a vessel that is in the MASTREP area must make, or arrange to be made, position reports in accordance with Schedule 1.
Penalty: 50 penalty units.
        (2)     An offence against subsection (1) is a strict liability offence.
        (3)     A person is liable to a civil penalty if the person contravenes subsection (1).
Civil penalty:        50 penalty units.
        (4)     However, subsection (1) does not apply if the master of a vessel is reporting to REEFVTS under Marine Order 56 (REEFREP) 2004.
Note   For a marine incident, there are reporting requirements for an owner and a master under sections 185 and 186 of the Navigation Act 2012 and Marine Order 31 (Ship surveys and certification) 2006.
7          MASTREP area
                 For the definition of prescribed area in subsection 221(3) of the Navigation Act, the MASTREP area is prescribed.
Schedule 1    Position reports
(subsection 6(1))
  
1          How a position report is to be transmitted
              A position report must be transmitted by AIS.
2          Information to be included
              A position report must include the following information about the vessel:
(a)   identity;
(b)   type;
(c)   position;
(d)   course;
(e)   speed;
(f)    navigational status;
(g)   any safety related information.
Note   Regulation 19.2.4 of Chapter V of SOLAS requires AIS to provide this information.
3          Operation of AIS
              The AIS must be operated in accordance with Regulation 19.2.4 of Chapter V of SOLAS.
Note   Regulation 19.2.4 of Chapter V of SOLAS provides that AIS must be operated taking into account the Guidelines for the onboard operational use of shipborne automatic identification systems (AIS) adopted by IMO Resolution A.917(22) as amended by IMO Resolution A.956(23).
4          Reporting AIS malfunction
              Any malfunction of the AIS must be reported to RCC Australia.
