VALUE OF ACTIVITIES, FEES FOR ASSESSMENTS AND STANDARDS FOR PROFESSIONAL DEVELOPMENT ACTIVITIES
(Clause 7A of Schedule 1, Regulations 9F and 9J and Paragraphs 9G(1)(c) and 9K(1)(c))
 
I, STEPHEN INGRAM, Chief Executive Officer, Delegate of the Minister for Immigration and Border Protection, acting under Clauses 7A of Schedule 1, Regulations 9F and 9J and Paragraphs 9G(1)(c) and 9K(1)(c) of the Migration Agents Regulations 1998 (‘the Regulations’):
 
1.                  REVOKE Instruments IMMI 13/015 signed on 6 June 2013 for clauses 7A and 7B of Schedule 1 of the Regulations, IMMI 13/016 signed on 6 June 2013 for paragraphs 9G(1)(c) and 9K(1)(c) of the Regulations and IMMI 13/021 (F2013L00982), signed on 6 June 2013 for regulations 9F and 9J of the Regulations.
 
2.                  DECLARE for clause 7A(a) of Schedule 1 of the Regulations the value of 10 Continuing Professional Development (CPD) points.
 
3.                  DECLARE for clause 7A(b) of Schedule 1 of the Regulations the value of 1 CPD point.
 
4.                  SPECIFY for clause 7A(a) of Schedule 1 of the Regulations the activities listed in      Schedule A that are mandatory for registered migration agents who are in their first year[1] of registration and who:
 
(a)    do not hold an Australian legal practising certificate; and
(b)   did not provide evidence to the Authority that they held an Australian legal practising certificate as part of their initial registration application; and
(c)    do not hold full membership of a recognised Australian professional association of accountants[2].
 
5.                  SPECIFY for clause 7A(b) of Schedule 1 of the Regulations the activities listed in      Schedule B that are mandatory for all registered migration agents in any year of registration.
 
6.                  SPECIFY for subregulations 9F(1) and 9F(2) of the Regulations a fee of $99.00 for performing assessments.
 
7.                  SPECIFY for regulation 9J of the regulations a fee of nil for performing assessments.
 
 
8.                  APPROVE for paragraphs 9G(1)(c) and 9K(1)(c) of the Regulations, the standard of Continuing Professional Development Approved Provider Standard Conditions as issued by the Office of the MARA.
 
This Instrument, IMMI 14/038, commences on the day after registration on the Federal Register of Legislative Instruments.

[2] Recognised Australian professional associations of accountants are CPA Australia, the Institute of Chartered Accountants in Australia or the Institute of Public Accountants.
[3] Mandatory status for the purposes of awarding CPD points relates to the completion, preparation or presentation of any of the specified CPD Activity Category titles.
