I, FIONA NASH, Assistant Minister for Health, make this determination under subsection 8(7) of the Australian Hearing Services Act 1991.

Part 1        Preliminary
 
1.               Name of Determination
 
This Determination is the Declared Hearing Services Amendment Determination 2014 (No. 2).
 
2.               Commencement
 
This Determination commences on the later of:
(a)    commencement of the Disability Services Amendment Act 2014 (WA);
(b)   1 July 2014.
 
3.               Authority
 
This Determination is made under subsection 8(7) of the Australian Hearing Services Act 1991.
 
4.               Schedule
 
Each instrument that is specified in the Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
 
 
Schedule
 
Declared Hearing Services Determination 1997
 
1         Section 3(1) (Definition of young NDIS participant)
 
             Repeal paragraph (b), substitute:
 
(b)   is either:
(i)a participant within the meaning of the National Disability Insurance Scheme Act 2013 and has been referred to the Authority in connection with the funding or provision of supports under the participant’s plan under Chapter 3 of that Act; or
(ii)      a participant within the meaning of the Disability Services Act 1993 (WA) and has been referred to the Authority in connection with the funding or provision of supports under the participant’s plan under section 26I of that Act.
