Comcare, acting under regulation 686 of the Work Health and Safety Regulations 2011 (WHS Regulations), having taken into account all relevant matters, grants an exemption from compliance with regulation 81 of the WHS Regulations on the terms prescribed in the attached Exemption Document.

EXEMPTION DOCUMENT
 
1.      Name
 
This Instrument may be cited as the Work Health and Safety Exemption to Regulation 81 (June 2014).
 
NOTE:          This Instrument is a legislative instrument within the meaning of the Legislative Instruments Act 2003 (see regulation 692(2) of the Work Health and Safety Regulations 2011).
 
2.         Applicant
 
This exemption has been granted on the written application of the Commonwealth as represented by the Australian Defence Force.
 
3.           Class of persons to whom the exemption applies
 
This exemption applies to all members of the Australian Defence Force.
 
4.         Thing to which the exemption relates
 
This exemption relates to the requirement to hold a high risk work licence in order to carry out a class of high risk work prescribed by the WHS Regulations.
 
5.         Circumstances in which the exemption applies
 
This exemption applies where members of the Australian Defence Force carry out a class of high risk work prescribed by the WHS Regulations.
 
6.         Provisions of the Regulations to which the exemption applies
 
The exemption applies to regulation 81 of the WHS Regulations.
 
NOTE:          Nothing in this instrument exempts any persons from complying with the provisions of the Work Health and Safety Regulations 2011 that are not subject to this instrument.
 
 
7.         Conditions on exemptions
 
There are no conditions on the exemption.
 
8.         Date exemption takes effect
 
This instrument commences on 1 July 2014.
 
9.         Duration of exemption
 
This instrument expires on 31 December 2014.
