CLASSES OF PERSONS
 
(Subparagraph 1222(1)(aa)(ii))
 
 
I, MICHAELIA CASH, Assistant Minister for Immigration and Border Protection, acting under subparagraph 1222(1)(aa)(ii) of the Migration Regulations 1994 (‘the Regulations’) hereby:
 
1.         REVOKE IMMI 05/062 signed on 20 June 2005 and published in Gazette Notice 25 (FRLI Registration F2005L01807), specifying a class of persons for the purpose of subparagraph 1222(1)(aa)(ii) of the Regulations; AND
 
2.         SPECIFY the following classes of persons for the purpose of 1222(1)(aa)(ii) of the Regulations:
 
            Class 1
 
            Persons who seek a student visa that is not subject to condition 8101 and who:
 
(a)                are not in immigration clearance; and
 
(b)               hold a student visa that is subject to condition 8101; and
 
(c)                are either
 
(i)                 enrolled in a registered course; or
 
(ii)               a Foreign Affairs student, Defence student or secondary exchange student.
 
 
Class 2
 
(a)                are not in immigration clearance; and
 
(b)               hold a student visa that is subject to condition 8101 or 8104; and
 
(c)                claim to be a member of the family unit of the holder of a student visa that is subject
to condition 8202.
 
This Instrument, IMMI 14/046 commences on 1 July 2014 immediately after the commencement of Migration Legislation Amendment (2014 Measures No. 1) Regulation 2014.
