1  Name of regulation
                   This regulation is the Water Amendment (Murray-Darling Basin Agreement) Regulation 2014 (No. 1).
2  Commencement
                   This regulation commences on the day it is registered.
3  Authority
                   This regulation is made under the Water Act 2007.
4  Expiry of this regulation
             (1)  This regulation expires on the day after it commences as if it had been repealed by another regulation.
             (2)  The expiry of this regulation by subsection (1) does not affect any amendment or repeal (however described) made by this regulation.
             (3)  Subsection (2) does not limit the effect of section 7 of the Acts Interpretation Act 1901 as it applies to the expiry of this regulation.
5  Schedule(s)
                   Each Act or instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Schedule 1—Amendments
  
Water Act 2007
1  Clause 2 of Schedule 1
Insert:
“service level agreement” means the service level agreement referred to in clause 35A.
2  After paragraph 9(c) of Schedule 1
Insert:
                    (ca)  to approve any amendments to the annual corporate plan in accordance with clause 35;
3  After paragraph 9(d) of Schedule 1
Insert:
                   (da)  to approve a statement of intent setting out collaborative arrangements under which the Ministerial Council will operate; and
4  Paragraph 29(2)(d) of Schedule 1
Omit “and”.
5  After paragraph 29(2)(d) of Schedule 1
Insert:
                   (da)  the service level agreement; and
6  After subclause 35(1) of Schedule 1
Insert:
          (1A)  If the Ministerial Council requests the Authority to prepare a draft amendment to the corporate plan to give effect to a decision of the Ministerial Council, the Authority must prepare the draft amendment and provide it to the Committee.
7  Subclause 35(2) of Schedule 1
Omit “considering the draft amendment”, substitute “considering a draft amendment provided to it under sub‑clause (1) or (1A)”.
8  Paragraph 35(3)(b) of Schedule 1
Omit “for further consideration”, substitute “and request that the Authority make changes to the draft amendment”.
9  At the end of Part V of Schedule 1
Add:
35A.  Service Level Agreement
                   The service level agreement between the Ministerial Council and the Authority will set out the key elements of how the Authority will undertake its responsibilities for the joint programmes and other functions under this Agreement encompassing:
                     (a)  the corporate plan (deliverables, standards, costs, timelines, risk assessment and risk treatment); and
                     (b)  the asset management plan (annual review and delivery); and
                     (c)  the objectives and outcomes document; and
                     (d)  financial and performance reporting; and
                     (e)  management and decision making protocols; and
                      (f)  audit and review processes.

Repeal the Schedule.
