Authorisation — to carry out maintenance on WHR aircraft
Exemption — to allow supervision of maintenance on WHR aircraft
1          Duration
                 This instrument:
(a)   commences immediately after the commencement of Civil Aviation Order 104.0 Amendment Instrument 2015 (No. 2); and
(b)   expires at the end of April 2018, as if it had been repealed by another instrument.
2          Repeal
                 Instrument CASA EX65/07 is repealed.
3          Application
                 This instrument applies to the carrying out of maintenance on an aircraft of a type mentioned in Schedule 1 (a WHR aircraft), and to the supervision of that maintenance, when the aircraft is operated under:
(a)   a special certificate of airworthiness in the limited category; or
(b)   an experimental certificate.
4          Authorisation
                 This instrument authorises a person, who is supervised in accordance with Schedule 2, to carry out maintenance on a WHR aircraft.
5          Exemption
        (1)     A person referred to in subsection (2) or (3), who meets the requirements of clause 1 of Schedule 2, is exempt from compliance with subregulation 33B (4), or 33I (3), of CAR 1988 to the extent set out in whichever of subsection (2) or (3) applies to the person.
        (2)     The holder of an airworthiness authority is exempt from compliance with a condition of the airworthiness authority insofar as the condition prevents the supervision of maintenance on a WHR aircraft in accordance with Schedule 2.
        (3)     The holder of an aircraft welding authority is exempt from compliance with a condition of the welding authority insofar as the condition prevents the supervision of welding work on a WHR aircraft in accordance with Schedule 2.
Schedule 1          Type of aircraft
              An aircraft described in subparagraph 21.189 (1) (a) (ii), historic aircraft mentioned in paragraph 21.189 (3) (a), or replica aircraft mentioned in paragraph 21.189 (3) (f), of CASR 1998.
Schedule 2          Conditions for maintenance on WHR aircraft
      1     The maintenance must be carried out under the supervision of a person who:
(a)   holds:
             (i)  an airworthiness authority issued under regulation 33B of CAR 1998; or
            (ii)  a welding authority issued under regulation 33D of CASR 1998; or
           (iii)  an authorisation under subregulation 42ZC (6) of CAR 1988;
        that covers the maintenance; and
(b)   is permitted by paragraph 42ZC (4) (a), (b) or (e) of CAR 1988 to carry out the maintenance.
      2     In clause 1, supervision means that the person supervising:
(a)   is the holder of an airworthiness authority or an authorisation covering the maintenance; and
(b)   is immediately available in person to give advice to, or answer questions from, the supervised person about the maintenance that he or she is performing.
