1  Name
                   This is the Legislative Instruments (Deferral of Sunsetting—Sydney Airport Curfew Dispensation Guidelines) Certificate 2015.
2  Commencement
                   This instrument commences on the day it is registered.
3  Authority
                   This instrument is made under paragraph 51(1)(c) of the Legislative Instruments Act 2003.
4  Definitions
                   In this instrument:
Act means the Legislative Instruments Act 2003.
5  Statement of reasons for issue of certificate
                   For paragraph 51(2)(a) of the Act, this section sets out the statement of the reasons for the issue of this certificate.
Statement of reasons
                   I am satisfied that the Dispensation Guidelines made under subsection 20(5) of the Sydney Airport Curfew Act 1995 would, apart from the operation of Part 6 of the Legislative Instruments Act 2003, be likely to cease to be in force within 12 months after the scheduled sunsetting day.
                   Any changes to the Guidelines should be considered in light of all factors which affect Sydney basin capacity management, including the Sydney Airport Curfew Act 1995, the Sydney Airport Demand Management Act 1997 and the Sydney Airport Slot Management Scheme 2013 in force under the Sydney Airport Demand Management Act 1997.
                   The Guidelines are due to sunset on 1 April 2015. A 12 month deferral of the sunsetting day for these Guidelines will be sufficient to allow appropriate time for consideration of all relevant factors affecting Sydney basin capacity management.
6  Deferral of sunsetting of the Dispensation Guidelines
                   The Dispensation Guidelines made under subsection 20(5) of the Sydney Airport Curfew Act 1995, for which the sunsetting day is 1 April 2015, are taken to cease to be in force under section 51 of the Act on 1 April 2016.
7  Repeal of this instrument
                   This instrument is repealed on 2 April 2016.
