1              Name of Determination
                This Determination is the Telecommunications (Relay Service Provision for the National Relay Service – Section of the Telecommunications Industry) Determination 2015.
2              Commencement
                This Determination commences on the day after it is registered.

3              Revocation
                The Telecommunications (Section of Telecommunications Industry) Determination No. 2 of 2001 [F2005B00225] is revoked.
4              Definitions
                In this Determination:
National Relay Service has the meaning given in section 4 of the TUSMA Act or in a corresponding provision of a replacement Act.
NRS means the National Relay Service.
NRSP means a person who provides a relay service for the NRS pursuant to a contract entered into, or a grant made, under the TUSMA Act or a replacement Act.
relay service means a service that allows a user of the service to communicate with other persons by means of an intermediary that relays communications between the user and the other person or persons.
replacement Act means an Act made after the commencement of this Determination that replaces the TUSMA Act insofar as the TUSMA Act deals with the NRS.
Telecommunications Act means the Telecommunications Act 1997.
TUSMA Act means the Telecommunications Universal Service Management Agency Act 2012.
5              Application
                This Determination applies to a person who is a NRSP.
6              Specification of telecommunications activity
                For the purposes of this Determination, the specified telecommunications activity is the provision of a relay service for the NRS.
7              Section of telecommunications industry
                Under subsection 110(3) of the Telecommunications Act, it is determined that,
persons:
(a)    to whom this Determination applies; and
(b)   who carry on, or propose to carry on, the telecommunications activity specified in section 6;
constitute a section of the telecommunications industry for the purposes of Part 6 of the Telecommunications Act, and in accordance with subsection 110(4) of the Telecommunications Act, the section is to be identified as the “National Relay Service Provider”.
