1              Name of Standard
         (1)   This Standard is the Telecommunications Disability Standard (Requirements for Customer Equipment for use with the Standard Telephone Service — Features for special needs of persons with disabilities — AS/ACIF S040) 2015.
         (2)   This Standard may also be cited as AS/ACIF S040-2015.
    Note          The AS/ACIF Standard, as adopted by this Standard, does not include any amendments that may subsequently be made by Communications Alliance Ltd to that instrument.  If such amendments are made, there will be a discrepancy between the terms of this Standard and those of the AS/ACIF Standard until such time as the amendments to the AS/ACIF Standard are adopted by the ACMA in a standard made under subsection 380(1) of the Telecommunications Act 1997.
2              Commencement
                This Standard commences on the day after it is registered.
   Note         All legislative instruments and compilations are registered on the Federal Register of Legislative Instruments required to be maintained under the Legislative Instruments Act 2003.
3              Revocation of the Telecommunications Disability Standard (Requirements for Customer Equipment for use with the Standard Telephone Service — Features for special needs of persons with disabilities — AS/ACIF S040) 2002 
                The Telecommunications Disability Standard (Requirements for Customer Equipment for use with the Standard Telephone Service — Features for special needs of persons with disabilities — AS/ACIF S040) 2002 [F2005B00240] is revoked.
4              Objects of Standard
                The object of this Standard is to provide for requirements relating to specified customer equipment that:
                (a)    is for use in connection with the standard telephone service; and
               (b)    is for use primarily by persons who do not have a disability; and
                (c)    has features that are designed to cater for any or all of the special needs of persons with disabilities.
5              Definitions
                In this Standard:
 
AS/ACIF Standard means the Australian Standard AS/ACIF S040:2001 – Requirements for Customer Equipment for use with the Standard Telephone Service - Features for special needs of persons with disabilities published by the Australian Communications Industry Forum Ltd (now known as Communications Alliance Ltd) published in March 2002.   
Note 1          The AS/ACIF Standard is available on Communications Alliance Ltd’s website at http://www.commsalliance.com.au.
 
 
Note 2          Other words and expressions used in this Standard have the meaning given by the Telecommunications Act 1997, including:
·         ACMA (see section 7)
·         customer equipment (see sections 7 and 21)
·         disability (see section 380)
·         standard telephone service (see section 7).
6              Application of Standard
                This Standard applies to customer equipment that:
                (a)    uses a telephone handset or keypad that is manufactured in Australia, or imported, for use with the standard telephone service; and
               (b)    is for use primarily by persons who do not have a disability; and
                (c)    has features that are designed to cater for any or all of the special needs of persons with disabilities.
7              Standard with which customer equipment must comply
                The customer equipment to which this Standard applies must comply with the AS/ACIF Standard.
8              Transitional arrangements for customer equipment in existence before the commencement of this Standard
                If:
(a)    customer equipment to which this Standard applies was in existence immediately before the commencement of this Standard; and
(b)   complied with the Telecommunications Disability Standard (Requirements for Customer Equipment for use with the Standard Telephone Service — Features for special needs of persons with disabilities — AS/ACIF S040) 2002 as in force immediately before the commencement of this Standard:
the equipment is taken to comply with this Standard.
