                   This instrument is made under paragraph 51(1)(c) of the Legislative Instruments Act 2003.
4  Definitions
                   In this instrument:
Act means the Legislative Instruments Act 2003.
5  Statement of reasons for issue of certificate
                   For paragraph 51(2)(a) of the Act, this section sets out the statement of the reasons for the issue of this certificate.
Statement of reasons
                   I am satisfied that the Public Lending Right Scheme 1997 (the Scheme) and the Public Lending Right Scheme 1997 (Modification No. 1 of 2000) (the Modification) would, apart from the operation of Part 6 of the Act, be likely to cease to be in force within 12 months after the scheduled sunsetting day for those instruments due to proposed amendments which will improve the administration of the Public Lending Right program.
                   The Scheme and the Modification are made under subsection 5(1) of the Public Lending Right Act 1985 (the PLR Act). The Government proposes that the PLR Act, the Scheme and the Modification be amended to streamline the regulatory framework for the Public Lending Right program. As a result, the Government anticipates that the Scheme and the Modification will be repealed and remade in early 2016.
                   The Scheme and Modification are due to sunset on 1 October 2015. A 12 month deferral of the sunsetting day for the Scheme and the Modification will likely avoid the need to remake them in their current form for the short period before the proposed amendments of the PLR Act and replacement legislative instruments are made and commence.
6  Deferral of sunsetting of legislative instruments
                   The following legislative instruments, for which the sunsetting day is 1 October 2015, are taken to cease to be in force under section 51 of the Act on 1 October 2016:
                     (a)  the Public Lending Right Scheme 1997;
                     (b)  the Public Lending Right Scheme 1997 (Modification No. 1 of 2000).
7  Repeal of this instrument
                   This instrument is repealed on 2 October 2016.
