I, Michael Ronaldson, Minister for Veterans' Affairs, hereby, under subsection 118(2) of the Veterans' Entitlements Act 1986:
 
(a) revoke the Veterans' Entitlements (Veterans' Children Education Scheme - Guidance and Counselling Services) Determination 2000 (Instrument No. 29/2000); and
 
(b) determine that a person in a class of persons in the Schedule is a person in respect of whom the Repatriation Commission may provide guidance and counselling services under the Veterans' Children Education Scheme.

Name of Instrument
 
This instrument is the Veterans' Entitlements (Veterans' Children Education Scheme - Guidance and Counselling Services) Determination 2000.
 
Commencement
 
This instrument commences on the day after registration.
 
Definitions
 
58B Defence Determination means a determination made under section 58B of the Defence Act 1903.
 
Black Hawk Helicopter Accident means the accident on 12 June 1996, in Australia, involving Black Hawk helicopters carrying members of the Defence Force.
 
dependent child, in relation to a member of the Defence Force, means a child of the member who is wholly or partly dependent on the member for economic support and is either:
 
(a)     under 16; or
(b)     16 or more but under 25, being a child who:
          (i)      is in full-time education at a school, college, university or other                                    educational institution; and
          (ii)     is not ordinarily in employment or working on his or her own                                      account.
 
ex gratia decision, means the decision of the Federal Government of Australia on 10 June 1997 to make lump sum payments in respect of members of the Defence Force:
 
(a) who were severely injured or killed in the Black Hawk Helicopter Accident;or
(b) who were severely injured or killed on or after 7 April 1994 while rendering continuous full-time service.
 
Note: the date 7 April 1994 is the date on which the Military Compensation Scheme under the Safety Rehabilitation and Compensation Act 1988 commenced.
 
member of the Defence Force includes a person who has ceased to be a member whether by reason of death or otherwise.
 
 
 
Schedule
 
A dependent child of a member of the Defence Force, where an additional death benefit or a severe injury adjustment was payable in respect of the member pursuant to the ex gratia decision or pursuant to a 58B Defence Determination.
 
Note 1: the terms "member of the Defence Force" and "Defence Force" are defined in subsection 5C(1) of the Veterans' Entitlements Act 1986, and a person to whom an amount is payable under a 58B Defence Determination includes a member who has ceased to be a member whether by reason of death or otherwise.
 
Note 2: under the Defence Act 1903, a member includes any officer, sailor, soldier and airman.
