Part 1—Preliminary
  
1  Name
                   This is the Australian Passports (Application Fees) Determination 2015.
2  Commencement
             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority
                   This instrument is made under the Australian Passports (Application Fees) Act 2005.
4  Definitions
Note:          A number of expressions used in this instrument are defined in the Act by reference to the Australian Passports Act 2005, including the following:
(a)    Australian passport;
(b)    child.
                   In this instrument:
Act means the Australian Passports (Application Fees) Act 2005.
business day has the meaning given by the Acts Interpretation Act 1901.
indexation factor has the meaning given by section 7.
Part 2—Fees
  
5  Application fees
             (1)  For section 4 of the Act, the fee in respect of an application of a kind mentioned in column 1 of an item (other than items 3, 7, 10 and 11) in the table in subsection (3) is:
                     (a)  for an application made in the calendar year starting on 1 January 2015—the amount mentioned in column 2 of the item; or
                     (b)  for an application made in a later calendar year:
                              (i)  if the indexation factor for the calendar year is less than 1—the fee for an application of that kind for the previous calendar year; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount of the fee for an application of that kind for the previous calendar year.
             (2)  For section 4 of the Act, the fee in respect of an application of a kind mentioned in column 1 of item 3, 7, 10 or 11 in the table in subsection (3) is:
                     (a)  for an application made in the calendar year starting on 1 January 2016:
                              (i)  if the indexation factor for the calendar year is less than 1—the amount mentioned in column 2 of the item; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount mentioned in column 2 of the item; or
                     (b)  for an application made in a later calendar year:
                              (i)  if the indexation factor for the calendar year is less than 1—the fee for an application of that kind for the previous calendar year; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount of the fee for an application of that kind for the previous calendar year.
Note 1:       Fees are payable at the time the application is lodged: see section 7 of the Australian Passports Act 2005.
Note 2:       Fees may be waived in certain circumstances: see section 27 of the Australian Passports Determination 2015.
             (3)  The following table sets out fees in respect of applications.

Note 1:       In relation to items 3 and 7 of the table, for a child who is 16 or 17 before 1 January 2016, the fees in items 2 and 6 apply.
Note 2:       In relation to item 9 of the table, an emergency passport application that is lodged before 1 January 2016 may incur an additional fee under section 6.
Note 3:       An Australian frequent traveller passport has extra visa pages.
Note 4:       The maximum period of validity for an Australian passport is determined under section 17 of the Australian Passports Determination 2015.
             (4)  Amounts worked out under subsection (1) or (2) must be rounded to the nearest whole dollar (rounding 50 cents upwards).
6  Additional fees in relation to applications
             (1)  For section 4 of the Act, the fee in respect of an application of a kind mentioned in column 1 of an item (other than item 2) in the table in subsection (3) is:
                     (a)  for an application made in the calendar year starting on 1 January 2015—the amount mentioned in column 2 of the item; or
                     (b)  for an application made in a later calendar year:
                              (i)  if the indexation factor for the calendar year is less than 1—the fee for an application of that kind for the previous calendar year; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount of the fee for an application of that kind for the previous calendar year.
             (2)  For section 4 of the Act, the fee in respect of an application of a kind mentioned in column 1 of item 2 in the table in subsection (3) is:
                     (a)  for an application made in the calendar year starting on 1 January 2016:
                              (i)  if the indexation factor for the calendar year is less than 1—the amount mentioned in column 2 of the item; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount mentioned in column 2 of the item; or
                     (b)  for an application made in a later calendar year:
                              (i)  if the indexation factor for the calendar year is less than 1—the fee for an application of that kind for the previous calendar year; or
                             (ii)  otherwise—the amount worked out by multiplying the indexation factor for the calendar year by the amount of the fee for an application of that kind for the previous calendar year.

Note 1:       In relation to column 2 of item 3 of the table:
(a)    paragraph (a) includes persons who are 75 or over (regardless of the period of validity of the passport); and
(b)    paragraph (b) includes a child who is 16 or 17 (regardless of the period of validity of the passport).
Note 2:       The Australian Passports Determination 2005 continues to apply in relation to fees for applications to replace lost or stolen Australian travel documents that are lodged before 1 January 2016: see paragraph 31(a) of the Australian Passports Determination 2015.
             (4)  The fee is in addition to the fee (if any) specified under subsection 5(1) or (2) in respect of the application.
             (5)  Amounts worked out under subsection (1) or (2) must be rounded to the nearest whole dollar (rounding 50 cents upwards).
7  Indexation factor
             (1)  The indexation factor for a calendar year is the number worked out using the following formula:
where:
index number, in relation to a quarter, means the All Groups Consumer Price Index number, being the weighted average of the 8 capital cities, published by the Australian Statistician in respect of that quarter.
index number for most recent September year means the sum of the index numbers for the 4 quarters in the year ending 30 September in the previous calendar year.
index number for past September year means the sum of the index numbers for the 4 quarters in the year ending 30 September in the year before the previous calendar year.
             (2)  The indexation factor for a calendar year is to be worked out to 3 decimal places (rounding up if the fourth decimal place is 5 or more).
             (3)  In working out the indexation factor:
                     (a)  use only the index numbers published in terms of the most recently published index reference period for the All Groups Consumer Price Index; and
                     (b)  disregard index numbers published in substitution for previously published index numbers (except where the substituted numbers are published to take account of changes in the index reference period).

8  Application of determination
                   Subject to this determination and to the Australian Passports Determination 2015, this determination applies in relation to applications lodged on or after the commencement of this determination.
