VENDORS

An Act to control the activities of vendors on the Beaches
and in-the National Parks of Antigua and Barbuda.

(2nd January, 1987.)

1. This Act may be cited as the Vendors Act.

Short title.

Application. 2. This Act applies to vendors on all beaches and in
the national parks of Antigua and Barbuda and in any other
place which the Minister may prescribe.

3. In this Act- Interpretation.

"Director Generaln means the Director General of
Tourism:

"beach" includes the land adjoining the foreshore of
Antigua and Barbuda and extending not more
than one hundred feet beyond the landward limit
of the foreshore;

"licensed vendors" means a person to whom a licence
under this Act is issued;

"Minister" means the member of Cabinet to whom the
responsibility for tourism is assigned;

"national park" means any place which is designated as

a national park under the National Parks Act;

"vendor" means any person who offers for sale any
wares, goods or service or solicits another person
to buy any form of entertainment, recreation, or
ownership in a business or enterprise whether per-
manent or temporary;

"vendor's licence" means a licence issued under
Section 4.

Vendor's licence. 4. No person shall carry on the business of a vendor
in any place to which this Act applies unless he holds a
licence issued by the Director General authorising him to
do so.

Conditions in 5 . Every person who holds a vendor's licence shall,
respect of

this Act applies conduct his trade in a specific enclosed or
defined area set aside for the purpose and shall-

(a) wear on a conspicuous place on his person a
badge bearing his photograph and the words

"Licensed Vendor" and the distinguishing number of
his licence written thereon;

(b ) display the licence in a conspicuous place on
the stall, shed, table or other place where his goods are
displayed or his service is advertised;

( c ) on demand by any police officer produce his
licence for inspection by such officer.

6. A licensed vendor may keep his stall, shed, table or HOUTS of

7. An application for a vendor's licence- Application for
licence.

(a) must be made to the Director General and
must be signed by the person applying to be licensed;

(b ) must state the given name and surname of the
person applying to be licensed and his place of resi-
dence;

( c ) must indicate the area or areas for which the
licence is required;

(4 must be accompanied by a certificate of char-
acter from the Police or a testimonial from some
upstanding person in the community.

8. The Director General shall consider all applications ,C;$ztiyF
for a vendor's licence and may-

(a) require the applicant to appear in person at
the Department of Tourism to be interviewed;

(b ) request such further information from the
applicant as he thinks fit.

9. (1) Where the Director General is satisfied that ~ , " z ~ ~ f e n c e .
the applicant is a fit and proper person to whom a vendor's
licente should be issued, the Director General shall issue a
vendor's licence to the applicant on such terms and condi-
tions as he thinks fit on payment of the fee set out in the

(2) The Director General may refuse to issue a licence
if he is satisfied that the number of licensed vendors on any
beach or in any national park or other place to which this
Act ~pp l i es exceeds a limit determined by the Director
General having regard to the maintenance of order and
good conduct on the beach or national park.

Duration of
licence.

10. (1) Every vendor's licence issued under this Act
shall be granted either for one year or for six months.

(2) Every vendor's licence whenever issued shall
expire-

(a) in the case of a licence for one year, on the
31st December next following the date of its issue;

(6) in the case of a licence for six months, on the
last day of June or December next following the date of
its issue.

the date on which it expires;

Register of 12. (1) The Director General shall keep a register of
licences.

address of every person to whom a vendor's licence is
issued, the number of every such licence, the date on which
it was issued and the expiry date and the area in respect of
which the licence was granted.

(2) The register shall be open to public inspection at
the office of the Department of Tourism during normal
working hours.

13. The Director General may suspend the licence of Suspension Or
revocation of

any vendor who is charged with the possession or offering licence.
for sale or barter of any drugs and may suspend or revoke a
licence granted under this Act where the licencee-

( a ) contravenes any condition of a vendor's
licence;

( 6 ) is guilty of an offence under this Act;

( c ) is guilty of a criminal offence, punishable by
imprisonment for a term of at least two years.

14. Any person who is aggrieved by a decision of the Appeals.
Director General under this Act may appeal from such deci-
sion to the Minister and any decision taken by the Minister
shall be final.

15. A licensed vendor may apply for a duplicate Duplicate

destroyed, and the Director General shall issue a duplicate
licence to such vendor on payment of the fee set out in the
Schedule.

16. The Minister may make regulations-

applies;

(c) prescribing the forms to be used for applica-
tions under this Act;

(4 prescribing all matters which are required to
be prescribed;

( e ) generally for the better carrying out of the
provisions of this Act.

17. Any person who contravenes any of the provi- Offences.
sions of this Act is guilty of an offence and liable on summa-
ry conviction to a fine of $500 for the first offence, and $750
for the second and every subsequent offence.
