AN ACT to amend the Magistrate's Code of Procedure Act (Cap.
48).

L 18th August, 1994 1

ENACTED by the Parliament of Antigua and Barbuda as
follows -

1. This Act may be cited as the Magistrate's Code of Procedure short title.
(Amendment) Act, 1994andrciened toin this Act as the principal
Act.

2. Section 27 is amended as fo~lows -

(a) by renumbering section 27 as section 27 (1);

(b) in paragraph (e) by deleting the words "two hundred
and forty dollars" and substituting the words "seven
thousand five hun&d dollars";

Amendment of
section 27.

(c) by deleting paragraphs (m), (a) and (0) and substitut-
ing the following -

AND (Amendment) Act, 1994.

BARBUDA

"(m) to exercise jurisdiction over all disputes and
differences between party and party touching
any breach of covenant or contract or promise,
injury to the person or other matter, except that
the damage or the sum claimed does not exceed
seven thousand five hundred dollars;

(n) to adjudicate actions of trespass to land, wherein
the damages or property claimed does not
exceed seven thousand five hundred dollars.";

(d) in sections 27 If) (i) and @ (ii), 94A, 147, 148 by
deleting the words "fifteen hundd dollars" and
substituting the words "seven thousand five hundred
dollars";

(e) by inserting the following new section -

"(2) Where a defendant disputes the value of any
property in dispute before the Magistrate, the Mag-
istrate may before entering into the case, enquire into
and determine the value thereof and such valuation
shall be conclusive for the purpose of deciding
whether the Magistrate has jurisdiction."

Amendment of 3. Section 97 (1) of the principal Act is amended -
Section 97 (1).

(a) by deleting the words "two years" and substituting
the words "five years";

(b) by deleting the words "three years" and substituting
the words "seven years".
