CHAPTER 210

THE IMPORTATION PROHIBITION (EPIDEMIC
DISEASES) ACT

1. This Act may be cited as the Importation Prohibi- short title.

2. (1) The Cabinet may by order prohibit during a may

infectious character prevails or any place in communication
with such a place.

(2) The Cabinet may by the same or any like order
direct that any part or parts of this Act shall not apply to
any part or parts of Antigua and Barbuda, and may by the
said order direct that any rules or regulations to be therein
stated shall in place of any of the provisions of this Act have
effect in such part or parts of Antigua and Barbuda, and
the Cabinet may by such rules and regulations confer any
powers and authorities which shall not be in excess of the
powers and authorities by the part or parts of this Act for
which such rules or regulations are substituted are given and
all such rules and regulations shall have the force and effect
of law as if they had been enacted in this Act.

3 . Every person who imports or attempts to import
into Antigua and Barbuda or lands or attempts to land in
Antigua and Barbuda or is any way concerned in or about
the importing into or landing in Antigua and Barbuda any
animal, article or thing in contravention of any such order,
and every person who receives any animal, article or thing
brought into Antigua and Barbuda in contravention of any
such order shall be guilty of an offence and shall be liable
on conviction before a Magistrate to a penalty not exceeding
three thousand dollars or to imprisonment with or without
hard labour for any term not exceeding three months:

Provided always that no person shall be convicted of
receiving any animal, article or thing brought into Antigua
and Barbuda in contravention of such order, who shall prove
that at the time when he received such animal, article or
thing he did not know that the same had been brought into
Antigua and Barbuda in contravention of such order and
that he gave information to the police immediately after he
first became aware of the fact.

revenue officer or any officer of police or police constable
or special constable and shall be forfeited to Her Majesty:

Provided that nothing in this section shall apply to any
animal, article or thing found in the territorial sea of Antigua
and Barbuda which is being conveyed in any vessel and which
may be proved by the person in possession thereof, or who
may claim the same, to be intended to be conveyed elsewhere
and not landed in Antigua and Barbuda, or in any part of
Antigua and Barbuda in which the landing thereof is
prohibited.

5 . Any animal, article or thing forfeited under the ~~;d;ofo; f~~t
