ANTIGUA AND BARBUDA

No. 11 of 1998

AN ACT to provide for the Incorporation of the Church of the
Nazarene, to vest certain lands therein and to provide for matters
incidental thereto.

[ 1st October, 1998 ]

WHEREAS the Church of the Nazarene has been serving the
people of Antigua and Barbuda since 1973 and later that year the
Church installed its first Antjguan lay-pastor; and

WHEREAS the Church acquired lands and built its first Church
Building in 1983 and currently there are five other churches
affiliated to the Church of the Nazarene throughout Antigua and
Barbuda; and

WHEREAS the Church has continued its programme of expand-
ing its ministry and providing theological training through the
Centralized Theobgical Study Programme located in St. Johnson's
Village, for those persons who wish to work in the Ministry of God;
and

WHEREAS lands and hereditaments have been at different
times conveyed in trust for the purposes of the said Church and its
constituents, or are now beneficially held, used, occupied or enjoyed
for such purposes by the same, or the officials or members thereof;
and

WHEREAS it is desirable and expedient that the Church of the
Nazarene shall have the right to acquire, hold, deal with and dispose
of movable and immovable property in Antigua and Barbuda for the
purposes of the Mission.

ENACTED by the Parliament of Antigua and Barbuda as
follows:

short title. 1. This Act may be cited as the Church of the Nazarene
(Incorporation) Act, 1998.

Incorporation. 2. The Church of the Nazarene is hereby constituted a body
corporate under the name and title of "The Church of the Nazarene"
with perpetual succession and a common seal and with power and
authority by that name to sue and be sued, to acquire and to hold real
and personal property for all purposes connected with the adminis-
tration of the affairs of the Church of the Nazarene in Antigua and
Barbuda and with power to sell, mortgage, alienate, lease, exchange
or otherwise dispose of the said property.

Execution of 3. All deeds of conveyance or reconveyance, documents by
leases, transfers, mortgages, charges, assignments or other deeds and documents
contracts by
Church. whatsoever and all powers of attorney and all notarial instruments

required to be executed by the said Church of the Nazarene shall be
deemed sufficiently executed if sealed with its common seal and
subscribed by the Executive Director or Chairman of the Board of
the Church for the time being and such execution shall be valid and
effectual at law.

4. All real and personal property in Antigua and Barbuda now
held by or vested in any person on behalf of the Church of the
Nazarene in Antigua and Barbuda are hereby transferred to and
vested in the Church of the Nazarene and its successors for the same
estates and interest and to the extent to which the same were
respectively at the time of the passing of this Act held or vested as
aforesaid, subject to the rights, reservations and charges if any, now
affecting the same and the trusts upon which the same are now held,
without conveyance, transfer or assignment.

5. Nothing in this Act contained shall aff&t or be deemed to
affect the rights of Her Majesty, her heirs and successors or any
body, politic or corporate or of any other person except such as are
mentioned in this Act and those claiming by, from or under them.
