ANTIGUA AND BARBUDA

THE CARIBBEAN COMMUNITY SKILLED NATIONALS (AMEND-
MENT) ACT, 2007.

No. 22 of 2007

AN ACT to amend the Caribbean Community Skilled Nationals Act, 1997 and for incidental and
connected purposes.

ENACTED by the Parliament of Antigua and Barbuda as follows:

1. Short title

This Act may be cited as the Caribbean Community Skilled Nationals (Amendment) Act 2007.

2. Amendment of section 2 of No. 3 of 1997-Definitions

Section 2 of the Caribbean Community Skilled Nationals Act (hereinafter called the principal Act)
is amended by inserting before “immigration officer” the following definition—

(a) “dependent” in relation to another person means—

(i) the spouse of such person provided the spouse is not living apart under a decree
of a competent court or a deed of separation;

(ii) the child or step-child under the age of sixteen years, of such person;

(iii) an adopted child under the age of sixteen years having been adopted by such person

in a manner recognized by law;

(iv) a parent and a grandparent wholly dependent on such person for their subsistence.

3. Insertion of section 5A

The principal Act is amended by the insertion after section 5 of the following section—

5A Prohibition of Entry

Notwithstanding sections 4 and 5, no person shall be permitted to enter Antigua and Barbuda—

(a) who is the subject of a deportation order issued against him under any enactment;

(b) who is afflicted with any contagious or infectious disease; or

(c) who is the subject of an Order of the Cabinet pursuant to Section 8 of the Immigration
and Passport Act Cap. 208(1)

4. Amendment of Section 8 –Qualifications for certificate

The Act is amended in subsection 8(1) by the deletion after the words “combinations of qualifica-
tions” of the word “which.”

5. Section 8A inserted –Qualified persons

The Act is amended by inserting after section 8, the following section—

8A Notwithstanding sections 8 and 9, an applicant who is a citizen of a qualifying Caribbean Com-
munity state and possesses any qualification or experience or combination of qualification and
experience that is to the satisfaction of the Minister proves that the applicant is—

(a) an artiste;

(b) a musician;

(c) a sports person; or

(d) a media worker,


is deemed to have satisfied the qualification requirements of this Act.

6. Amendment of section 9-Functions of the Secretary-General

Section 9 (2) of the principal Act is amended by the insertion after “8(1)(b)” of “and 8A”.
7. Amendment of section 11-Dependant family members

(1) Section 11(1) of the principal Act is amended by the deletion of the words “spouse and” in
line one, and of the words “spouse or” in line seven.

(2) Section 11(2) of the principal Act is amended by the deletion of the words “spouse and” in
line two, and of the words “spouse or” in line eight and nine.

8. Section 11A inserted-Contagious or infectious disease

The Act is amended by inserting after section 11 the following section—

11A Where a deportation order has been issued against a dependent family member referred to in
subsection 11(1)’ the person is the subject of an Order of the Cabinet pursuant to section 8 of the
Immigration and Passport Act, Cap. 208, or that person is afflicted with any contagious or infectious
disease, the immigration officer shall not permit that person to enter Antigua and Barbuda.

9. Section 15A inserted-Regulations

The Act is amended by inserting after section 15 the following section—

15A The Minister may by regulations amend the Form of Certificate as set out under Schedule II.

10. Substitution of Schedule II

Schedule II of the principal Act is repealed and the following Schedule substituted—
