ANTIGUA AND BARBUDA

No. 19 of 2002

AN ACT to amend the Antigua and Barbuda Merchant Ship-
ping Act, Cap. 28.

[ 6th March, 2003 ]

ENACTED by the Parliament of Antigua and Barbuda as
follows -

1. Antigua and Barbuda Merchant Shipping (Amendment) short title.
Act 2002.

2. Section 9 of the Antigua and Barbuda Merchant Shipping Amendment of
Act is amended as follows - section 9.

, Cap. 28.

(a) by the repeal of paragraphs (a) and (b) of subsec-
tion (2) and the substitution of the following -

"(a) established under and subject to the laws of
Antigua and Barbuda or registered as an ex-
ternal company under the Companies Act; NO. 18 of 1995.

ANTIGUA 2 Antigua and Barbuda Merchant Shipping No. 19 of 2002.
AND (Amendment) Act 2002.

BARBUDA

(b) it has its principal business in Antigua and
Barbuda or appoints a resident agent in
Antigua and Barbuda."

(b) by the repeal of paragraph (iii) of subsection (4) and
the substitution of the following -

"(iii) the owner of the vessel is qualified for, se-
cures and maintains registration in Antigua and
Barbuda as a foreign maritime trust or corpo-
ration or other legal entity and where he ei-
ther maintains at all times an operating office
in Antigua and Barbuda or appoints a resident
agent."

(c) by the insertion after subsection (4) of the follow-
ing -

No. 18 of 1995.

"(5) The owner of any ship which is regis-
tered as an external company under the Com-
panies Act and secures and maintains regis-
tration of that ship in Antigua and Barbuda
shall be exempted from the payment of income
tax, capital gains tax and any other direct tax
or impost that may be levied or collected in
Antigua and Barbuda in respect of his ship
ping business for f i Q years."
