ANTIGUA AND BARBUDA

THE ANTIGUA AND BARBUDA LABOUR CODE (AMENDMENT) ACT, 2007

No. 7 of 2007

AN ACT to amend the Antigua and Barbuda Labour Code cap. 27 and for incidental and connected
purposes.

ENACTED by the Parliament of Antigua and Barbuda as follows:

1. Short title

This Act may be cited as the Antigua and Barbuda Labour Code (Amendment) Act, 2007.

2. Amendment of Part 2 of Division C

Part 2 of Division C of the Antigua and Barbuda Labour Code is amended by inserting after section
C20 the following—

“C 20A Regulations

The Minister may issue regulations for the purposes of carrying out the provisions of this Part.”

3. Amendment of Section J 13 (2)

Section J 13 (2) of the Antigua and Barbuda Labour Code is amended —

(a) by the repeal of the proviso in paragraph (a) and the substitution of the following —

“Provided that where an employee becomes or having become remains a member in good
standing of the certified trade union no such fee shall be deducted by the employer”;

(a) by the repeal of subparagraph (b)(i) and the substitution of the following subpara-
graph—

“(2) (b)(i) The negotiating fee referred to in paragraph (2)(a) shall, in the case of a
worker who is not a union member, in the bargaining unit, be equal to the membership
dues of the certified trade union;”

(c) by the repeal of subparagraph (b)(ii) and the substitution of the following subparagraph—

“(2) (b)(ii) This section shall apply notwithstanding any other law which limits
deductions by employers or other persons in respect of wages or other remuneration
payable to employees.”
