About geodetic and cartographic activities

This Law defines legal bases of activity in the field of geodesy and cartography in Turkmenistan and aimed at the creation of conditions to meet the needs of the state, businesses and individuals in the surveying and mapping products.

Article 1. Geodesic and cartographic activities.

Geodetic and cartographic activities - this production, technical, scientific activities related to the conduct of geodetic and cartographic works, the creation of geodesic and cartographic products.

Article 2. Legislation of Turkmenistan on Surveying and Mapping

Legislation of Turkmenistan on Surveying and Mapping consists of this Law and other normative legal acts of Turkmenistan governing the implementation of geodetic and cartographic activities.
If the international agreements of Turkmenistan stipulate other provisions than those contained in this Law, the norms of international agreements shall prevail.

Article 3. Scope of this Law.

This Act applies to government bodies that regulate in accordance with their competence, geodetic and cartographic activities, legal entities and individuals, including foreign ones, are customers or implementing geodetic and cartographic works or holders of geodetic and cartographic materials and (or ) data as well as implementing geodetic and mapping products.

Article 4. Objects of geodetic and cartographic activities

The objects of geodetic and cartographic activities are:
land and water surface in the territory of Turkmenistan, on other territories, defined by international treaties of Turkmenistan, as well as geographical objects on them;
Space, including natural and artificial celestial bodies.

Article 5. The state system of coordinates, elevation, gravity measurements, a number of large-scale topographic maps and plans

In the territory of Turkmenistan established a unified state system of coordinates, elevation and gravity measurements.
The large-scale series of topographic maps and plans is set depending on their destination.
The order of introduction and implementation of a unified state system of coordinates, elevation, gravity measurements and the establishment of a number of large-scale topographic maps and plans approved by the Cabinet of Ministers of Turkmenistan.


Article 6. The surveying and cartographic works.

By the geodetic and mapping activities are the definition of the parameters of the Earth's shape and external gravitational field;
Creating, updating, publication and printing of topographic maps and plans in the graphic, digital, photographic and other forms;
Creation, development and maintenance of the geodetic, leveling and gravimetric networks;
Earth remote sensing;
Geodynamic study on the basis of geodetic measurements and space;
The formation of the State cartography and geodesy fund of Turkmenistan;
Creation of geographic information systems and their management;
Development, compilation and publication of general geographic, political, administrative, scientific reference and other thematic maps and atlases, cartographic training manuals;
Metrological support of geodetic and cartographic works,
standardization, registration and ordering of used geographical names;
Production of surveying and mapping equipment;
Materials processing and manufacturing of aerospace survey products based on these materials;
Perform research and development work in the field of geodesy and cartography.
By the geodetic and mapping activities are also geodetic and cartographic services geodetic, geological, geophysical, hydrographic, hydrometeorological, land reclamation, agroforestry, forestry research, as well as the linear tracks and other facilities.
Surveying and mapping work can be carried out by legal and natural persons having the appropriate license for their implementation.
Surveying and cartographic work of national importance, as well as carried out for the purposes of defense and security of Turkmenistan, performed body authorized to carry out state regulation of geodetic and cartographic activities, as well as other persons under the decision of the Cabinet of Ministers of Turkmenistan

Article 7. State ownership of the geodesic and cartographic products

The geodesic and cartographic products, including topographic, surveying, hydrographic, aerospace and gravimetric materials and data collected during the geodetic and cartographic works in the territory of Turkmenistan, as well as the materials and data of the State cartography and geodesy fund of Turkmenistan are the property of the State | ||
Article 8. Public administration geodetic and cartographic activities


The geodesic and cartographic activities in Turkmenistan is administered by the state.
State Administration of geodetic and cartographic activities carried out by the authorized body.
The competent body authorized to exercise state control geodetic and cartographic activities include the establishment and operation in the territory of Turkmenistan of the unified state system of coordinates, elevation and gravity measurements;
Execution on the territory of Turkmenistan, geodetic and cartographic works;
Establish technical requirements, rules and regulations for the geodetic and cartographic works, and how to exercise them;
Creation of the state of geographic information system and its management;
Satisfaction of needs of the state, businesses and individuals in the geodesic and cartographic products;
Geodetic, cartographic, topographic and hydrographic support of the delimitation, demarcation and checking of the state border line of Turkmenistan;
Creating and maintaining the State cartography and geodesy fund of Turkmenistan;
Geodetic and cartographic support of the city, land and other inventories;
Coordination of the implementation of geodetic and cartographic work for the purpose of a uniform state policy in the field of geodesy and cartography;
Control of movement across the customs border of Turkmenistan of equipment and technical devices for the implementation of geodetic and cartographic works;
Other powers specified in the Regulations of this body.

Article 9. The State supervision and control of geodetic and cartographic activities

The State supervision and control of geodetic and cartographic activities in Turkmenistan is provided by a body authorized to carry out state management of geodesic and cartographic activities. The head of the body authorized to exercise state control geodetic and cartographic activities, and his first deputy - are also the chief state inspector for geodetic supervision.
The position of the state geodesic control approved by the Cabinet of Ministers of Turkmenistan.
The list of officials of the body authorized to exercise state control geodetic and cartographic activities, both are state inspectors for geodetic supervision, and their competence established by the Regulation o state geodetic supervision.


Article 10. Financing of geodetic and cartographic activities

Surveying and cartographic work of national importance, financed by the State budget and other sources not prohibited by the legislation of Turkmenistan.
Needs of enterprises, institutions and organizations in carrying out geodesic and cartographic operations are financed by their own funds.

Article 11. Metrological support of geodetic and cartographic activities

Metrological support of geodetic and cartographic activities carried out in accordance with the law in the field of standardization, metrology and certification.

Article 12. Licensing of geodesic and cartographic activity

The geodesic and cartographic activities in Turkmenistan are subject to licensing in accordance with the legislation of Turkmenistan.
Licensing of geodesic and cartographic activity produced by the body authorized to carry out state management of geodesic and cartographic activities.
Not subject to licensing:
surveying services as part of the construction and assembly activities;
Geodetic and cartographic work carried out on the training grounds of educational institutions;
Surveying the measurements of spatial deformation of utilities and buildings.

Article 13. State cartographic-geodetic Fund of Turkmenistan

Surveying, mapping, topographic, hydrographic, aerospace and gravimetric materials and data, including in digital form, obtained as a result of geodetic and cartographic works, constitute State cartographic-geodetic Fund of Turkmenistan. State cartographic-geodetic Fund of Turkmenistan is administered in organ authorized to exercise governance of geodesic and cartographic activities.
Regulations on the State cartography and geodesy fund of Turkmenistan approved by the Cabinet of Ministers of Turkmenistan.

List of geodesic and cartographic products, materials and data, replacing the originals or copies thereof, regardless of departmental affiliation, the creation of space, technology and the method of fixing the information to be stored in the permanent storage of the State cartography and geodesy fund of Turkmenistan, approved by the body authorized to carry out governance geodetic and cartographic activities, in coordination with the main archive Department under the Cabinet of Ministers of Turkmenistan.
Materials and data of the State cartography and geodesy fund of Turkmenistan shall not be included in the assets of the privatized entities.
Materials and data of the State cartography and geodesy fund Turkmenistan, included in the National Archival Fund of Turkmenistan, kept in accordance with the Law of Turkmenistan "On the National Archive Fund."
Access to materials and data of the State cartography and geodesy fund of Turkmenistan containing information constituting state secrets, in accordance with the legislation of Turkmenistan.
The transfer to third parties received materials and data of the State cartography and geodesy fund of Turkmenistan and the copying is not allowed without the permission of the body authorized to carry out state management of geodesic and cartographic activities.
The use of materials and data from the State cartography and geodesy fund Turkmenistan is paid. The fee for the use of materials and data of the State cartography and geodesy fund Turkmenistan established by the Ministry of Economy and Finance of Turkmenistan
enterprises, institutions and organizations, being on budget financing, use of data of the State cartography and geodesy fund donated Turkmenistan on the basis of a written request.

Article 14. Mandatory representation of geodetic and cartographic materials and data in the State cartographic-geodetic Fund of Turkmenistan

Legal persons, regardless of ownership, individuals engaged in geodesic and cartographic activities in the territory of Turkmenistan, are obligated to transmit one instance they have created geodetic and cartographic materials and data in the State cartographic-geodetic Fund of Turkmenistan.
Transfer of geodetic and cartographic materials and data related to the state or other secret protected by law, is carried out in accordance with the legislation of Turkmenistan.


Article 15. Copyright in a geodesic and cartographic products

The copyright for geodesic and cartographic products, including topographic, surveying, hydrographic, aerospace and gravimetric materials and data, obtained as a result of geodetic and cartographic activities governed by the laws of Turkmenistan.

Article 16. Protection of public points of geodetic networks

Items state geodetic networks (astronomical surveying, geodetic, leveling and gravimetric), including geodetic points placed on light beacons, signs and other engineering structures, are public property and are under state protection. Regulations on the Protection of points of geodetic networks approved by the Cabinet of Ministers of Turkmenistan.
Lands designated for placing points of geodetic networks in accordance with the legislation of Turkmenistan.
Demolition exterior signs or perezakladku centers of geodetic points of state geodetic networks produced by the body authorized to exercise state control geodetic and cartographic activities, or with his authorization.
Public land users, land owners on the rights of private ownership or lease, in the territory of which the points of the state geodetic networks deployed are obliged to ensure their safety in the event of damage or destruction to notify the authority authorized to carry out state management of geodesic and cartographic activities as well as provide the ability to entrance (approach) to the points of the state geodetic networks in conducting geodetic and cartographic works.

Article 17. Responsibility for violation of legislation on the geodetic and cartographic activities

Officials and citizens guilty of violating this Law and other normative legal acts in the field of geodesy and cartography shall be liable in accordance with the legislation of Turkmenistan.
Damage caused by legal or natural persons as a result of geodetic and cartographic activities shall be compensated in accordance with the legislation of Turkmenistan.

Article 18. International cooperation in the field of geodesy and cartography

The body authorized to exercise state control geodetic and cartographic activities, participates in international cooperation in the field of geodesy and cartography, provides the international legal protection of the interests of Turkmenistan
