Decision of the Government of the People of the Blackang Province to amend the Modalities for the Implementation of the Plant of Agriculture in the Blackang Province

(Adopted at the 16th ordinary meeting of the Government of the Blackonang Province on 11 December 2008, No. 6 of the Order of the People's Government of the Blackon Province, which was published from the date of publication)

The Government of the people of the Blackang Province has decided to amend the NPS in the Blackang Province as follows:

Article 3, paragraph 3, was amended to read: “The management of agricultural plant and phytosanitary systems in the reclaimed areas of the agricultural authorities of the farming system is responsible for the specific implementation of the plant and phytosanitary institutions attached to it”.

Delete Article 6, paragraph 2: “Statusal and phytosanitary institutions at all levels may, in accordance with their work, hire ad hoc sanitary practitioners to assist in the work of local agricultural institutions, scientific research units. The approach to the establishment of ad hoc invitees was developed by provincial agricultural executive authorities.”

Article 7, paragraph 3, was deleted: “A unit and individual engaged in the production of sanitary, phytosanitary products and contingencies must be registered by local phytosanitary institutions in accordance with the provisions of provincial agricultural administrative authorities”.

Article 9: “All levels of fauna and fauna shall have a three-year survey of harmful species in the area, with a focus on the harmful biological life of the sanitary nature.

Article 17: “The plant and quarantine institutions at all levels shall implement the sanitary quarantine of the origins of the Territory, good species, nurseries, and export agricultural production bases.

The units and individuals who test, demonstrate, breed and produce sanitary plants should apply to local plant and quarantine institutions for the quarantine of the plant's seeds, and receive vaccination certificates. Removal and user units and individuals should carefully check the status of seed quarantine, verify the number; apply for review to local plant and phytosanitary institutions in a timely manner, without quarantine or quarantine.

Annex: Agricultural phytosanitary approach in Blackang Province (Amendment 2009)

Article 1 develops the implementation approach in line with the State Department's Plant Quarantine Regulations (hereinafter referred to as the following regulations).

The scope of application of this implementation approach means domestic agricultural plant and phytosanitary, excluding forestry and quasi-shore plants.

Article 3: The Ministry of Agriculture of the Blackon Province is responsible for the implementation of the provincial plant and phytosanitary institutions.

The Executive Office, the municipality and the district agricultural administrative authorities are responsible for agricultural plant and phytosanitary activities within the region.

Agricultural plant and phytosanitary management in the agro-recovery area is administered by the agro-recovery authorities, which are responsible for specific implementation.

Article IV, plant and quarantine institutions at all levels, must be equipped with a specific number of special-time sanitary inspectors and the progressive establishment of sound plants and laboratory laboratories.

Article 5

(i) Access to vehicle stations, airports, ports, mails, warehouses and quarantine plants, plant production, processing, sale, storage, probationary sites for the implementation of quarantine and quarantine surveillance, as prescribed.

Article 9

In areas where epidemics are concerned, plant and quarantine institutions can be assigned to local road joint checkpoints or timber checkpoints; in the event of a pandemic, the provincial people have approved the establishment of plant and quarantine checkpoints and the implementation of plant and phytosanitary activities.

Article 11. Removal of plant, plant and plant products, which fall under the following conditions, must be reported to local plants and quarantine institutions prior to the shipment:

(i) In addition to the list of plant, plant and plant products subject to quarantine, which must be subject to quarantine prior to the delivery of the district-level administrative regions where the epidemic occurs.

(ii) Forecasts, trees and other breeding materials, whether they are included in plant, plant and plant products that are subject to quarantine, and to the extent, quantity and means of transport, mail, must be quaranted.

Article 12

(i) Redeployment units and individuals must obtain prior consent from the plant and plant quarantine institutions and provide quarantine requests to the outward units in accordance with the quarantine requirements;

(ii) Redeployment units or individuals, in line with the quarantine requirements of the provincial plant and phytosanitary institutions, are reported to the plant and quarantine institutions at the location, and, after quantification, are issued by provincial phytosanitary institutions or by the authorized plant and phytosanitary institutions. However, the transmission of breeding materials, such as seeds for the outskirts of the province, must be subject to provincial phytosanitary institutions and the issuance of quarantine certificates.

(iii) Redeployment units or individuals shall apply to the local plant and phytosanitary institutions in which they are located, as well as to the provincial plant and phytosanitary institutions or the authorized plant and quarantine institutions, which are requested by provincial phytosanitary institutions or by their authorized plant and phytosanitary institutions, and can be transferred to the plant and phytosanitary certificates issued by the provincial plant and phytosanitary institutions.

Plant and quarantine institutions at all levels are entitled to check or review of the recoordinated plant, plant and plant products, and to review the problems identified in the review, which are addressed by the relevant plant and quarantine institutions.

Article 14. (ii) No treatment of contaminated packaging materials, delivery tools, sites, warehouses, etc., as requested by plant and quarantine institutions;

(iii) Exclusively, from abroad, or from the designation of sites, or from the requirement of the plant and quarantine institutions;

(iv) Removal of plant, plant and plant products that are subject to quarantine, as well as, in the course of transport, the production of plants, flora and fauna, or packagings that are authorized to destroy the licensee;

(v) Amphet, seals, symbols and enthusiasm forfeiture, sale and transfer of plants;

(vi) In violation of the provisions of this approach, the proliferation of epidemics is triggered.

One of the cases indicated in subparagraphs (i), (ii), (iii), (iv) and (v) of the previous paragraph is not yet a crime, and the plant and quarantine institutions can forfeiture illegal proceeds.

In violation of the plant and plant products that are to be transported in violation of this implementation approach, the plant and quarantine institutions have the right to rescind, forfeiture, destroy or punish the use. The cost of destruction is borne by the responsible person.

Article 21 Psychologists are administratively disposed of by their units or superior authorities, which constitute a crime, and are criminalized by the judiciary in accordance with the law.

Article 2 does not determine the administrative penalties of the plant and quarantine institutions, which may apply for review to the agricultural administrative authorities of the plant and quarantine institutions that have made administrative sanctions decisions, within sixty days of the date of receipt of the review decision, and may be brought before the People's Court within fifteen days from the date of receipt of the review. The party may apply for the enforcement of or enforcement by the People's Court of Justice.

Article 23 of this application is implemented from the date of publication.
